Every Case Is Different, Every Case Is the Same

Getting Justice for Every Client We Represent

About a year ago, I had a case that I’ll never forget.

It was a grisly, severe injury that put her in the hospital for days. She underwent three separate surgeries on her leg before finally being discharged. But the struggle didn’t end there. Her

It all happened at a local restaurant. To get into the establishment, customers had to open the door and climb five rather steep stairs until they were in the restaurant proper. The stairs were covered in old, shabby carpet, ripped in several places, and jutting out into the walkway. You may be able to guess where this is going. My client was heading into this restaurant one regular evening when her foot caught on the carpet. Everything after that happened very fast. Her body hurtled forward and slammed full-speed into the ground. Though she was able to break her fall with her arms, she continued to tumble down the stairs, snapping her leg in two places.

injury forced her out of her job at a hospital billing department for eight solid months, resulting in an enormous amount of missed wages. If she had gone to another firm, it’s likely she would have been turned away. Slip and fall cases are tricky, and they often require a certain amount

easy with the confidence that we’re well aware of the tricks insurance companies play on the insured, and of the endless tactics they use to take advantage of regular people. Every case is different. You never know what a client is going to be like, what their specific needs will be, or what the nature and circumstances surrounding their injury

are until they sit down in your office. The same goes for the insurance companies. Adjusters are people, and the companies they serve are diverse in the ways they approach compensating those who depend on them. But the longer I do this, the more I realize that every case comes down to the same thing: securing justice for the client and allowing them to move on and live their life. These aren’t people looking to strike it rich from a massive settlement; they simply want to pay off their medical bills and get back to the business of recovery. It’s a privilege to be a part of that process. –Mark Stewart

In the end, we were able to secure her a fantastic result, including complete compensation for her injuries, all her lost wages, and damages for pain and suffering. Needless to say, she was thrilled. After a long year plagued with injury and financial insecurity, we ended up with a resounding win. Cases like this keep me coming into work each day. As a personal injury attorney, you’re constantly helping people receive adequate representation in the face of adversity. There’s just no way that somebody coming in off the street

ROBIN TINGLE REVIEW

This review is for the parents out there desperately trying to find help for their adult child. You know that fearful phone call you get in the night when your daughter was injured as a passenger in an accident and is in an ambulance on the way to the hospital? For me, hearing the wrong person’s voice on the other end of the phone while I was five states away was just HORRIBLE. Of course, you want to train your adult child (22 years old) how to handle dealing with all the details of getting insurance companies to just pay the bills they’re supposed to, according to the various vehicle policies. But, of course, it’s just not that easy. They keep transferring your child to new representatives. And they’re not answering calls and emails. His insurance (since he was the driver) is saying they’ll consider paying later and that she has to pay all the bills first. Then, they will decide what they will and will not pay. Her insurance is saying she was the passenger, so it’s not on them (even though his insurance was technically refusing to pay!). To hear your child having a panic attack and crying on the phone because the bills are now showing up every single day — and the collections phone calls almost every hour, threatening her excellent credit rating — just made me feel completely HELPLESS! TIME FOR A LAWYER!

things, and described what could and should be done for my daughter. I was absolutely convinced that he would be the VERY BEST attorney for my child. I scheduled an appointment for us to all meet with him in three days. Damian was very professional, kind, and thorough in his questions. He provided solid answers and a VERY thorough plan of action. He made lots of notes and seemed very sincere in wanting to take care of my daughter, even though it was a pretty small case comparatively. I LITERALLY took a deep breath and sighed as they were signing paperwork. I just KNEW my child would be VERY well taken care of and actually had trust in this attorney that we just met. And the excellent care did not stop there!! He, his staff, and others within the Advocates group communicated with my daughter every single step of the way and kept her updated regularly through phone calls, texts, and emails. At her request, they also kept me in the loop. Talk about going above and beyond!! What started out as everyone passing the buck and no one paying any bills wound up as BOTH insurances paying the policy amount. (GO FIGURE!) Then, the medical bills that originally totaled

more than DOUBLE the amount of those policies wound up

being negotiated down extremely well! The bills were paid through that settlement, and she never had to handle any part of it. The attorney, Damian, received his money, AND my daughter wound up with enough money to pay cash for a car, pay down debt, and buy some new clothes and a pedicure for both of us!

This mama is happy!!

But, how to search? Who to choose? She is in pain from her injuries and completely overwhelmed. She can’t work and is spiraling into depression. Okay. Mom will take the reins from five states away. I sat down and made six phone calls. It is business hours, so why can’t I actually talk to a lawyer or even a screener? I just want to get some answers as to my daughter’s rights ... frustrating! Then, I called the next one on my list: the Advocates. WOW! WHAT A DIFFERENCE! The attorney, Damian Kidd, actually answered the phone himself and listened to the 20 minutes of concerns I had. He listened compassionately, explained a lot of

I absolutely cannot imagine how badly it all could have gone if nothing had been done or the wrong attorney or law firm was acquired. This was probably one of the very best decisions my daughter has ever made, and I am incredibly proud that she followed her gut feelings and chose the very best! I hope that this review is helpful to you and speaks to your needs well. You will not be disappointed when choosing this wonderful group of people!

Car Accident Insurance Claim Filing 101

After you’re in a car accident, the insurance company for the at-fault party should pay for all repairs. However, sometimes insurance companies will want to investigate the accident before agreeing to pay. If they’re dragging their feet and you need your car repaired

While your car is in the shop, the at-fault driver’s insurance company is required to provide a rental vehicle to you, and they will pay for the towing and storage of your vehicle as long as the amount is reasonable. If your vehicle is totaled in the accident, the at-fault insurance company is only required to pay for your rental until they have made you an offer for your total loss. When selecting a place to get your car repaired, you’re welcome to take your car to the body shop of your choice. If you’re looking for recommendations, the Advocates work closely with a few shops that always provide great service. Alternatively, if you don’t want to have your vehicle repaired, you can opt to get an estimate of the damage and have the insurance company pay you directly. If the other motorist doesn’t have car insurance, you may be in a sticky situation, unless you have uninsured motorist property damage coverage, which usually has low limits and requires a deductible. You may have to fix your car out of your own pocket.

sooner rather than later, you may want to utilize your own policy’s collision coverage, if you have it. With this option, you can opt to have your own insurance pay to repair your car, typically less a deductible. Later, you’ll recover the deductible from the at-fault party’s insurance.

How Farmers Grow Those Giant Pumpkins

How Farmers Grow Those

GIANT Pumpkins

Forklifts and cranes may be used mainly for construction work, but every fall, thousands of backyard gardeners use them as gardening tools — or rather, harvesting tools — for their largest single crop.

Massive pumpkins aren’t practical, but they can become a minor tourist attraction in your hometown, and even win a few thousand bucks if they’re really huge. However, with the time and effort it takes to get them that big, farmers aren’t in it for the money. They’re in it for the glory. Growing these monstrous fruits (yes, they are technically fruits) is kind of like breeding a racehorse. It takes practice, cultivation, and even good genes. Competitive growers will often purchase the seeds of the previous year’s champions for their plant. After preparing the soil to make it extra fertile, they’ll plant the pumpkin in late winter or early spring.

Before the gourd starts growing, flowers on the plant need to be pollinated. Farmers will usually take it upon themselves to pollinate, using pollen from plants with proven genetic lines. Winning pumpkins usually claim their “father” plant and “mother” seed, like racehorses. Growing a great pumpkin is practically a full-time job, with some farmers reporting spending 40 hours a week on it. Using heated soil, installing fences to reduce wind, adding sand to the patch, and other specific cultivation techniques give the pumpkin a fighting chance to grow into a monster. But, in the end, there’s an element of luck.

The competitive growing industry is getting bigger (pun intended). In 1979, the largest pumpkin on record was 438 pounds. Since 2008, the world record has been broken every year. The reigning heavyweight champion, grown in Germany last year, weighed in at 2,623 pounds. That’s as much as a 2018 Toyota Yaris or 1,748 standard pumpkin pies.
