Pre-employment compliance checks It is a legal requirement for all new colleagues to provide proof of their Right to Work in the UK in accordance with the Immigration, Asylum and Nationality Act 2006. As an employer, we have a duty to prevent illegal working. You should conduct document checks to make it harder for people with no Right to Work in the UK to unlawfully obtain or stay in employment, and to make it easier for you to ensure that you only employ people who have permission to perform the role. Certain roles are also subject to the receipt of a criminal record check (also known as a Disclosure and Barring Service (DBS) check). If needed, the advert and job description should state this. This guide will give you an overview of the documents a candidate is required to bring to their interview as proof of their Right to Work in the UK and also the process you need to follow.
