We want to have as many happy experiences as possible, but sometimes, a pending divorce can complicate our ability to live life to the fullest. With Valentine’s Day on the horizon, many individuals who are in the midst of a divorce wonder if they can and should date. The situation around dating while your divorce is pending is complicated, and the answer is probably not what you want to hear. Many states throughout the country allow for no-fault divorces, where no matter what happens, one spouse cannot be punished or blamed for the marriage’s deterioration. However, Georgia is not a no-fault divorce state. This means that a divorcing spouse can claim that the other spouse caused the failure of the marriage. Things like mental incapacity, impotence, imprisonment for more than two years, cruel treatment, habitual intoxication, and adultery are all grounds for a fault-based divorce. Georgia does not have legal separation, which means the state considers you married until your divorce is finalized. If you date while your divorce is pending, it is technically considered adultery, which, as stated above, is grounds for a fault-based divorce. By dating during your divorce, you are putting the entire proceedings at risk. While it might not significantly affect the actual divorce itself, you may see consequences related to alimony payments, child custody, and even parenting time, especially if your spouse claims you started a relationship or were living with your new partner while still technically married. While it might seem like dating is a great way to distract yourself from your pending divorce, doing so could lead to additional challenges later on.
