Second Arrest Interview First Constable: Alright, I think we’ve covered everything, which is good. That’s that. That’s all the questions that we need to ask. I just need to really stress about the intervention order, do you understand that — I know you may not agree with it

–MM: I do understand, absolutely I understand it, but

–First Constable: You just can’t keep doing it, because what happens is the Magistrate might remand you next time, do you understand what that is?

MM: I’ll go to jail

First Constable: Yeah, so what happens is they’ll handcuff you like this [motioning]

MM: At least I’ll have somewhere to stay and I’ll get fed. Look I understand that you’re warning me about it and I do understand. I am totally, can’t believe, that all of the things that have been done to me — and let’s not forget that I was the victim of a family violence event — where I received a family violence intervention order where I was told, right left and center, “just ring 000”. A lawyer told me that I’ll get my keys back and

–Corroborator: I need to talk to you about that — he never did talk to me

MM: Yeah alright, I’m just gobsmacked. And I understand that you’re caring about making sure that I know

–First Constable: And I know you haven’t been remanded before, but what happens is basically, you’ll go in the back police cells, it’s not like there’s a nice bed and stuff like that. It’s like a slab in the side of the wall and basically like a foam mattress, that’s it. And you could be in there potentially for days. — I would have been on remand for over 150 days! Victoria Police took over a year to realise they did not have evidence to charge me with stalking and withdrew the charge. The two police lawyers one of whom was head of the family violence unit and present in the magistrates court when the errors were made refused to protect me against family violence. These two police lawyers applied to the very same magistrate who had made the error to revoke the invalid Personal Safety Order.
