practicable steps to provide and maintain a working environment that is safe and without risks to health associated with bullying or as a result of failing to respond to bullying behaviour, an employee, including a manager or supervisor, has acted in a way that fails to take reasonable care for the health and safety of others at a Workplace Workplace. Bullying Definition Workplace bullying is repeated, unreasonable behaviour directed at an employee or group of employees that creates a risk to health and safety. Employers have a responsibility under the OHS Act to maintain a workplace that is safe and without risks to psychological and physical health and safety, so far as is reasonably practicable. Complaints that are not true and made to cause harm or distress are known as vexatious or malicious complaints. If a report of bullying is found to be vexatious or malicious, disciplinary action or counselling may be considered against the person who made the report. The Personal Safety Order Act and the Family Violence Act both state that a Magistrate cannot place a Personal Order against a family member. The Personal Safety Order Act family member has the meaning given in section 8 of the Family Violence Protection Act 2008; family violence intervention order means a family violence intervention order within the meaning of section 11 of the Family Violence Protection Act 2008; For the purposes of this Act, harassment means a course of conduct by a person towards another person that is demeaning, derogatory or intimidating and includes such conduct that is carried on by or through a third person. 5 Meaning of prohibited behaviour (c) harassment; or (d) property damage or interference; or Meaning of property damage or interference For the purposes of this Act, property damage or interference means repeated, intentional— (a) damage to, or destruction of, any property of a person, including a person's pet; (b) substantial interference with any property of a person, including withholding any property of a person;
