Pregnant Workers Fairness Act Notice The Massachusetts Pregnant Workers Fairness Act prohibits discrimination against employees due to pregnancy or conditions related to pregnancy. The law also requires employers to provide reasonable accommodations to employees who are pregnant or have a condition related to pregnancy. Conditions related to pregnancy include, but are not limited to, morning sickness, lactation, or the need to express breast milk. The procedures for requesting an accommodation are described in the Accommodations for Pregnancy, Childbirth, and Related Medical Conditions policy. Benefits Paid Family and Medical Leave CREA, LLC provides time off to eligible employees who qualify for paid family and medical leave (PFML) benefits under Massachusetts law. PFML benefits are funded through a state tax.
Eligibility
To be eligible for PFML, you must work in Massachusetts and meet the financial eligibility requirements for unemployment benefits under Massachusetts law at the time of your requested leave.
Leave Entitlement and Usage
You may take up to 12 weeks of paid family leave in a benefit year for any of the following reasons:
The birth of a child and in order to care for that child (leave to be completed within 12 months of the child's birth). The placement of a child with you for adoption or foster care and in order to care for the newly placed child (leave to be completed within 12 months of the child's placement). To care for a family member with a serious health condition. A qualifying exigency of a family member who is a military member on covered active duty or called to covered active-duty status (or has been notified of an impending call or order to covered active duty). You may take up to 26 weeks of paid family leave in a benefit year to care for a family member who is a covered service member and who has a serious injury or illness related to active-duty service. You may take up to 20 weeks of paid medical leave in a benefit year to care for your own serious health condition, which renders you unable to perform any of the essential functions of your position. For purposes of this policy, the leave year is the consecutive 52-week period beginning on the Sunday immediately before the first day that you take paid family or medical leave. Family member means your spouse, domestic partner, child, parent, or parent of your spouse or domestic partner; a person who stood in loco parentis to you when you were a minor; or your grandchild, grandparent, or sibling.
Covered service member means:
A member of the armed forces, including a member of the National Guard or Reserves, who is: o Undergoing medical treatment, recuperation, or therapy; o Otherwise in outpatient status; or o Otherwise on the temporary disability retired list for a serious injury or illness that was incurred by the member in the line of duty on active duty in the armed forces, or a serious injury or illness that existed before the beginning of the member's active duty and was aggravated by service in the line of duty on active duty in the armed forces; or
