WHAT IS TUPE? TUPE is an acronym for Transfer of Undertakings (Protection of Employment) Regulations 2006 . This regulation protects employees whenever a business, or part of a business, is transferred from one entity to another . It also protects employees when a contract is taken from one supplier and given to another. Put simply, if the work carries on after the transfer of a business then the current employees are the ones who will continue to do it.

MY COMPANY IS FACING A POSSIBLE TUPE TRANSFER, WHAT SHOULD I DO? There are strict rules regarding consulting staff when there is a possible TUPE transfer, as well as strict rules regarding the information sharing between the companies. Companies should always seek advice when contracts are won and lost . It is worth noting that often a redundancy situation may prove to be a TUPE rather than redundancy.

WHAT HAPPENS IF I NEED TO DISMISS EMPLOYEES DURING THE TUPE? There are ways to change the terms and conditions as well as dismissing employees but there needs to be a strong reason to do so and the employer needs to follow clear processes.
