INDIAN GAMING ASSOCIATION RESOLUTION 1-SAN-BOD-03-30-26 TITLE: Opposing the Commodities Futures Trading Commission Proposal to Regulate Futures Gaming Contracts WHEREAS , the Indian Gaming Association (IGA) is an intertribal association of 184 federally recognized Indian Tribes established to support Indian gaming and defend Indian sovereignty; and WHEREAS , Indian Tribes are sovereigns that pre-date the United States, with prior and treaty protected rights to self-government and to our Indian lands; and WHEREAS, the Constitution of the United States, through the Treaty, Commerce, and Apportionment Clauses and the 14th Amendment, recognizes the sovereign status of Indian Tribes as Native nations established prior to the United States; and WHEREAS , the Indian Gaming Regulatory Act (IGRA) acknowledged and confirmed the inherent sovereign powers of Tribal Governments; and WHEREAS, IGA passed resolution 3-SAN-BOD-3-30-25 : Urging the Commodities Futures Trading Commission to Prohibit Sports Contracts from Being Listed or Made Available for Clearing or Trading, last year; and WHEREAS, the Commodities Futures Trading Commission (CFTC) continues to allow event contracts, including sports contracts to be offered without any practical oversight, under the guise of self-certification; and WHEREAS, many event contracts have been let since IGA’s original resolution, involving, war, terrorism that have opened the CFTC to allegations of insider trading; and WHEREAS, numerous Indian tribes and states have sued the CFTC for violating tribal and state law respectively for allowing sports contracts to be traded; and WHEREAS, legislation has been introduced to limit the type of event contracts, including sports contracts, available for self-certification; and WHEREAS, the CFTC issued an Advance Notice of Proposed Rulemaking on March 16, 2026; and WHEREAS, the CFTC is “seeking information and public comment on statutory core principles
