Recently, I learned that Feb. 1 is National Get Up Day, and it got me thinking about a time in my life when I was literally knocked down and how that moment turned out to be a pivotal point in shaping my journey. During my senior year of college, I was on a completely different path. I had plans to pursue a football career, and law school had never even crossed my mind. However, life had other intentions for me, as I suffered a traumatic sports injury
setbacks and hardships. Without my traumatic sports injury, I would have never found this path, and I would have never been able to help others in the way I do now. So, to anyone currently facing an injury or setback, my advice is simple: be a victor over a victim. Life might throw unexpected challenges our way, and the actions of others might rip things away from us, but in those moments, strive to rise above.

The National Floor Safety Institute states that slip and falls account for over 1 million hospital visits annually. With these high statistics, you’d think that proving a slip-and-fall injury case would be simple; however, determining fault can be challenging and requires experienced legal assistance. If you have experienced a slip-and-fall injury, there are several elements to prove to validate your case. NEGLIGENCE AND LIABILITY One step in your slip-and-fall case is to prove that the property owner was specifically negligent. This means they failed to act reasonably prudent and potentially ignored possible risks or violations. • If the hazardous condition existed long enough for the owner to eliminate it • Whether or not the owner regularly checked for repairs and damages • If there was reasonable justification for the creation of the hazard • If poor lighting or limited visibility played a role in slip and fall YOU DIDN’T CAUSE THE ACCIDENT YOURSELF In a split-and-fall case, defendants typically argue they are not at fault because you caused the accident yourself. DUTY TO THE VICTIM A manager or shop owner is responsible for maintaining their property and ensuring no condition creates dangerous risk. Properly labeled signs and other methods can clarify that precautions have been taken to reduce risk. Otherwise, the individual can claim that, though the owner could have had control of the dangerous situation, they refused to do so. KNOWN FOR POTENTIAL DANGER In this scenario, an expert witness is called to explain inspections and maintenance that should typically be performed regularly to prevent dangers. If the witness proves the known potential for danger but that the manager was improper in caring for the area, it could help prove your slip-and-fall case. DANGEROUS CIRCUMSTANCE The individual must prove that the defending party knew or reasonably suspected that someone could have been harmed on the premises but chose to ignore it. DAMAGES RELEVANT TO THE CASE This is the last and most important element to proving your slip-and-fall case. DIRECTIONS
1. Season chicken with salt and pepper. In a skillet over high heat, add olive oil and allow it to heat up. Then add chicken. 2. Let cook for 6 minutes or until golden brown. Repeat on the other side. Remove cooked chicken to a plate and set aside. 3. Reduce heat to medium and add minced garlic, broth, and heavy cream to the skillet. Stir sauce for 1 minute. 4. Add sun-dried tomatoes, oregano, and red pepper flakes to the mixture. 5. Bring sauce to a simmer, then reduce heat to medium-low. Add chicken back to the skillet, coating each side. Cook until chicken reaches 165 F.
