V. Top Product Liability And Mass Tort Class Action Settlements In 2024 The plaintiffs’ class action bar was enormously successfully in obtaining class-wide settlements in this area in 2024. The top ten products liability and mass tort class-wide settlements totaled $23.396 billion in the past year. This total was just short of the 2023 total of $25.83 billion. However, both these numbers were 50% lower than the total in 2022, when a series of opioid settlements fueled a total of $50.32 billion.
1. $10.3 billion – In Re Aqueous Film-Forming Foams Product Liability Litigation, MDL 2873 (D.S.C. Mar. 29, 2024) (final settlement approval granted in a class action to resolve claims with 3M for the damage the plaintiffs have and will incur due to its signature PFAS that were used for decades in specialized fire suppressants, called aqueous film-forming foams, that were sprayed directly into the environment and reached drinking water). 2. $4 billion – Komar Maui Properties, et al. v. County Of Maui , Case No. 24-CV-178 (D. Haw. Aug. 1, 2024) (global settlement reached resolving over 450 lawsuits filed in state and federal court that will provide compensation to all who brought claims stemming from the 2023 fire that left more than 100 people dead and destroyed the town of Lahaina). 3. $2.2 billion – In Re Zantac (Ranitidine) Products Liability Litigation, Case No. 20-MD-2924 (S.D. Fla. Oct. 9, 2024) (settlement agreement reached in a multi-district action to settle 80,000 cases claiming Zantac heartburn medication or the generic ranitidine caused them to develop cancer). 4. $1.37 billion – In Re Prescription Opiate Litigation, Case No. 17-MD-2804 (N.D. Ohio Mar. 25, 2024) (settlement reached wherein Kroger will pay dozens of states and thousands of counties, municipalities, and Native American tribes to resolve allegations the grocery store chain contributed to the opioid crisis). 5. $1.18 billion – Camden, et al. v. E.I. DuPont de Nemours & Co., Case No. 23-CV-3230 (D.S.C. Feb. 8, 2024) (final settlement approval granted in a class action to resolve claims in a multidistrict litigation for the firefighting agent aqueous film forming foam, which contains per- and polyfluoroalkyl substances (PFAS)).
