Re: Comments on Proposed Rules Amending Parts 514 and 522 and Request to Extend Comment Period for Other Proposed Rules Dear Chairman Simermeyer, On behalf of the National Indian Gaming Association’s member tribes, we wish to comment on the Proposed Rules recently published in the Federal Register by the National Indian Gaming Commission (NIGC), and specifically on the content of the Proposed Rule published on December 9, 2021, seeking to amend the regulations governing the submission and approval of gaming ordinances and resolutions, and amendments thereof, as set forth in 25 C.F.R. Part 522. As a preliminary matter, we are writing to you, in part, to express our disappointment in your publication of these Proposed Rules during the holiday season (i.e., the beginning of December) – a time when many Tribal government and Tribal Gaming Regulatory Authority (TGRA) employees are not in the office. As of now, there are four Proposed Rules that have open comment periods: 1. “Facility License Notifications” which was published on December 1, 2021, with its comment period ending on January 3, 2022; 2. “Fees” which was published on December 2, 2021, with its comment period ending on January 3, 2022; 3. “Background Investigations for Persons or Entities With a Financial Interest in or Having a Management Responsibility for a Management Contract” which was published on December 2, 2021, with its comment period ending on January 3, 2022; and 4. “Submission of Gaming Ordinance or Resolution” which was published on December 9, 2021, with its comment period ending on January 10, 2022.
