But I Wasn’t Drinking, Officer!
You Can Receive A DUI for Consuming Drugs
When most people think of a DUI offense, they think of alcohol consumption, but not all DUI cases have to involve alcohol. You can be charged with driving under the influence if you have consumed drugs while behind the wheel of a vehicle. This goes for illegal drugs as well as prescription drugs. In Los Angeles, we have seen an increasing number of DUI drug prosecutions involving prescription and illegal drugs. Here is everything you need to know about DUI that involves drug consumption. What makes consuming drugs a DUI? Driving under the influence includes any substance that affects your vision, hearing, speech, judgment, and coordination. Drugs can affect these regular facilities once they are consumed and can impair your driving skills. Some people think you cannot be charged with a drug DUI if you have a prescription, but that’s not the case. DUI charges can still apply to you even with a valid prescription. What are the most common drugs? Medications used to treat anxiety, depression, and panic attacks are the common prescriptions law enforcement officers see in a DUI. Other common prescription drugs include
fentanyl, morphine, Xanax, and OxyContin. In addition, if you are under the influence of LSD, marijuana, methamphetamines, or cocaine, you will also be charged with a DUI. How do you test for a drug DUI?
Blood alcohol content tests are used for DUI cases involving alcohol, but they cannot be used in a drug DUI. Instead, a law enforcement officer can administer either a blood or urine test to determine if you were driving with drugs in your system. They can also conduct field sobriety tests that assess your balance and coordination. This can include walking in a straight line, checking your eye coordination, and balancing on one foot.
