6.2 Cross-Border Dynamics
For organisations operating across ASEAN and globally, AI governance increasingly involves managing cross-border legal and operational complexity. For example, an enterprise AI model may be developed in Singapore, trained on regional data pools, hosted on cross-border cloud infrastructure, and deployed to interface with customers across multiple legal jurisdictions simultaneously. Boards must recognise that a sector-speci c AI application approved in one market may require extensive technical redesign or distinct data containment structures in an adjacent territory due to conicting local mandates, including: • Data sovereignty and localisation: Varied regional requirements regarding where personal data must be stored, processed and audited. • Automated decision-making restrictions: Distinct legal criteria governing customer consent, automated pro ling, and the right to human intervention. • International extraterritorial mandates: Stringent international regulations, such as the EU AI Act, which impose strict
compliance classi cations and heavy statutory penalties on any organisation whose AI systems interface with Europe’s markets or data subjects. Management may be tempted to resolve these cross-border variances through ad- hoc, localised workarounds. Over time, this tactical approach creates highly fragmented controls, obscured risk aggregation, and severe governance blind spots. Cross-border expansion multiplies corporate AI liability because data laws, regulatory approaches and tech sovereignty demands are unharmonised. Boards must establish baseline compliance metrics while empowering local business units to adapt to localised legal regulations.
