TITLE IX

TITLE IX GRIEVANCE PROCEDURE

Preamble Hodges University is committed to maintaining an educational and work environment free from unlawful discrimination and harassment. Title IX of the Education Amendments of 1972 (Title IX) provides, “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.” In accordance with Title IX as interpreted by the United States Department of Education, the University has adopted this policy which prohibits discrimination on the basis of sex, and provides a formal grievance process to address violations. For this purpose, conduct will be deemed to have occurred on the basis of sex if such conduct occurred because of an individual’s gender, sexual orientation, gender identity and transgender status. This policy applies to any student, employee,

or other individual that participates in a University program or activity in the United States, regardless of the individual’s sex, sexual orientation, enrollment or employment status, disability, race, religion, or national origin. All claims regarding sexual harassment, sexual/ gender discrimination, sexual violence, or sexual misconduct should be filed in accordance with this Title IX policy regardless of student or employment status. General Definitions • Advisor of Choice . An advisor of choice is a person selected by the Complainant or Respondent to advise and accompany the Complainant or Respondent throughout the investigation and adjudication process. An advisor of choice may be any person, including an attorney. The institution does not appoint or pay for an advisor of choice. An advisor of choice’s role is limited to the functions further described in this policy. • Complainant . The term Complainant refers
