Disapproval

■ The Secretary may only disapprove a compact if it violates: – IGRA, – Any other provision of Federal law that does not relate to jurisdiction over gaming on Indian lands, or – The trust obligations of the United States to Indians. ■ The Department seldom issues out-right disapproval letters. Since 1989, it has only disapproved about two dozen compacts.

No Action

■ No action on a compact does not effectively end a compact. Rather, if the Department takes no action within 45 days of filing to approve or disapprove the proposed compact, it will take affect as “deemed approved.” ■ Why would the Department decline to take any action? – The Department may not wish to allow the imprimatur of its approval attached to the compact because: ■ It may have reservations about particular provisions
