III. Top BIPA Class Action Settlements In 2023 In BIPA-related class actions, 2023 saw robust settlements, but a decline when compared to 2022. The top ten BIPA class action settlements totaled $147.86 million vs. $278.9 million in 2022.
1. $68.5 million – Parris, et al. v. Meta Platforms , Case No. 2023-LA-672 (Ill. Cir. Ct. Oct. 11, 2023) (final settlement approval granted in a class action alleging that the company violated the Illinois Biometric Information Privacy Act). 2. $28.5 million – Sosa, et al. v. Onfido, Inc. , Case No. 20-CV-4247 (N.D. Ill. May 5, 2023) (preliminary settlement approval granted for class-wide claims that an identification verification service provider violated the Illinois Biometric Information Privacy Act). 3. $16.7 million – Vaughan, et al. v. Biomat USA Inc ., Case No. 20-CV-4241 (N.D. Ill. Sept. 19, 2023) (final settlement approval granted for a class action alleging claims that three blood donation centers unlawfully collected and stored Illinois plasma donors' biometric fingerprint information without first obtaining their informed consent, in violation of the Illinois Biometric Information Privacy Act). 4. $10.85 million – Sayas, et al. v. BioMetric Impressions Corp., Case No. 2020-CH-00210 (Ill. Cir. Ct. Oct. 25, 2023) (preliminary settlement approval granted in a class action to resolve claims that the company violated the Illinois Biometric Information Privacy Act by collecting consumer fingerprints without consent). 5. $6.997 million – Starts, et al. v. Little Caesar Enterprises Inc ., Case No. 19-CV-1575 (N.D. Ill. Sept. 7, 2023) (preliminary settlement approval granted in a class action to resolve claims that the
