2. If the parent of a private school child with a disability agrees with, but wishes to decline, the IEP developed by the team shall:
a. Develop an Individual Services Plan (ISP) in accordance with this policy and federal and state laws and regulations using the appropriate ISP forms. b. Ask the parent to indicate his/her agreement with, by checking the box next to the following statement on the appropriate service plan form “I agree that the district has offered my child a free appropriate public education. However, I am voluntarily placing my child in a private school.”

IEP/IFSP Policy
A. Pursuant to federal and state law and regulations, the LEAs served by the DMSELPA shall spend a proportionate share of federal funds on providing special education and related services to private school children ages three to 22 with disabilities eligible for special education services. B. The DMSELPA shall develop an IEP/IFSP policy regarding the special education and related services to be provided to private school children ages three to 22 with disabilities eligible for special education services. Such IEP/IFSP Policy shall be developed after consulting, in a timely and meaningful way, with representatives of private school children with disabilities, including private school administrators, teachers, parents and students, in order to identify:
1. Disabling conditions that are served;
2. Services that will be provided;
3. How, where, and by whom services will be provided; and
4. How services will be documented and evaluated.
C. The IEP/IFSP Policy shall be reviewed by the DMSELPA annually by consultation with representatives of private school children ages three to 22 with disabilities including private school administrators, teachers, parents, and students.
