Introduction
Local Education Agencies (LEAs) maintain records on all students but even more so on students identified with special needs. These records are cumulative and follow the entire school history of the student from the time of first enrollment through graduation or at the completion of their course of study. The information contained within these files may cover the student’s family background, medical information, school disciplinary actions, psychological evaluations, intelligence test scores, grades, individualized education programs (IEPs), standardized test scores, and a wide variety of other sensitive information. It is the responsibility of the LEA to ensure the confidentiality, security, and maintenance of those records according to IDEA 2004, California Education Code, the Family Educational Rights and Privacy Act (FERPA), and the Title 5 California Code of Regulations .
