16.4 Election to Transfer - A member of the bargaining unit, if qualified, may elect to 1 transfer to another classification in the same salary range or demote to any classification 2 with a lower salary range in which there is an opening, with the approval of the 3 Superintendent. 4 16.5 Voluntary Demotion or Transfer 5 16.5.1 A bargaining unit member laid off for lack of work or lack of funds may forfeit 6 displacement rights and may accept a voluntary reduction in assigned time, or demotion 7 to a vacancy in a lower classification, provided the bargaining unit member has worked 8 in the lower classification. Unit members electing this provision shall retain sixty-three 9 (63) months return rights to the original position. 10 16.5.2 Members of the bargaining unit who take voluntary demotions or voluntary 11 reductions in assigned time in lieu of layoff shall be, at the option of the member, 12 returned to a position in their former class or to positions with increased assigned time as 13 vacancies become available, and without limitation of time, but they shall be ranked on a 14 reemployment list in accordance with their proper seniority. 15 16.6 Step Placement Unit members who are displaced or demoted shall maintain their salary 16 schedule step based on their most recent vacated position. 17 16.7 Substitute and Short Term Assignments 18 16.7.1 Unit members shall not be laid off from any position when substitute and short 19 term employees remain in the same classification. 20 16.7.2 Unit members who are laid off shall be offered in order of seniority any substitute 21 and short-term assignments. 22 16.8 Reemployment Rights 23 16.8.1 A thirty-nine (39) month reemployment list shall be established by seniority (hire 24 date). Laid off unit members shall be offered in writing and by certified mail to the last 25 known address, reemployment in their classification or a lower classification in which 26 they held permanent status in order of seniority. 27
