ARTICLE VIII: LEAVE PROVISION

8.1 Sole Benefits - The benefits which are expressly provided in this Article VIII are the sole 2 leave benefits that are part of this collective agreement, and it is agreed that other statutory or 3 regulatory leave benefits are not incorporated either directly or implied into this Agreement, nor 4 are such other benefits subject to the Grievance Procedure set forth in Article XII. 5 8.2 Summer Session Leaves - Members of the bargaining unit who are employed expressly 6 for summer session assignments shall be entitled to take only the following leaves during the 7 summer session: 8 1. Illness or Injury Leave (8.3); 9 2. Industrial Accident and Illness Leave (8.6); and 10 3. Bereavement Leave (8.7). 11 Members of the bargaining unit also receive vacation accrual for summer session employment. 12 See Section 8.13, Vacations. 13 8.3 Illness or Injury Leave - Illness or injury leave shall be for physical and mental 14 disability absences which are medically necessary and caused by illness, injury, pregnancy 15 disability, or quarantine. 16 8.3.1 Eligibility 17 8.3.1.1 A member of the bargaining unit employed five (5) days a week for a 18 fiscal year of service by the District shall be entitled to twelve (12) days leave of 19 absence for illness or injury without loss of compensation. The illness or injury 20 entitlement for the year shall be credited at the beginning of the fiscal year. 21 8.3.1.2 A member of the bargaining unit employed five (5) days a week who is 22 employed for less than a full fiscal year is entitled to that proportion of twelve 23 (12) days leave of absence for illness or injury as the number of months they are 24 employed bears to twelve (12). 25
