ARTICLE XII: GRIEVA N CE PROCEDURE 1 12.1 The purpose of this grievance procedure is to provide, at the lowest administrative level, 2 a means by which a grievance may be resolved in an efficient manner in an atmosphere of 3 courtesy and cooperation. Neither the District nor the Association shall withhold any known 4 arguments and/or evidence which could contribute to the resolution of the grievance at Levels I 5 or II. 6 12.2 Since it is important that grievances be processed as rapidly as possible, the number of 7 days indicated at each level is a maximum. Any extension of time must be pursuant to written 8 agreement between the District and the grievant. All time limits shall consist of working days 9 which shall be any day in which the District administrative offices of the school district are open 10 for business. 11 12.3 All procedural documents, communications, and records dealing with the processing of a 12 grievance shall be filed separately from the personnel files of the participants and shall be treated 13 as confidential material. These materials shall not be reviewed for decisions regarding 14 reemployment, promotion, assignment, or transfer. 15 12.4 Grievance hearings and meetings shall be conducted at a time that will provide an 16 opportunity for the aggrieved party and all parties of interest to be present. When mutually 17 scheduled hearings are held during the duty day, parties of interest and one (1) job representative 18 shall be excused without loss of pay or other benefits. 19 12.5 The aggrieved party shall be present at all meetings and hearings and may be represented 20 by his/her Association representative at all meetings and hearings of the grievance procedure. 21 12.6 If two or more members of the bargaining unit have the same grievance against an 22 individual, then the grievance may be consolidated for purposes of hearing and decision, 23 provided each member files a separate grievance and provided further that the rights of the 24 parties are not thereby prejudiced. 25
