12.9.4.1 Appeal to the Superintendent or the Superintendent's Designee

The Assistant Superintendent, Human Resources, upon receipt of a request that

the Superintendent or the Superintendent's designee hear the case, shall within

4

three (3) days transmit the request to the Superintendent together with copies of

5

all pertinent information and materials developed at previous steps. Within

6

fifteen (15) days from the date the Superintendent or the Superintendent's

7

designee receives the request for hearing he/she shall conclude the investigation,

8

summarize the findings in writing, and render a decision in writing. Copies of

9

such decision shall be transmitted personally, by courier or by registered or

10

certified mail, to the grievant, his/her immediate supervisor, and the Assistant

11

Superintendent, Human Resources. The decision of the Superintendent or the

12

Superintendent's designee shall be final and binding on all parties.

12.9.4.2 Appeal to Arbitrator

12.9.4.2.1 CSEA shall have the exclusive right to determine if a

14

15

grievance moves forward to arbitration under this section. Upon

16

request of an arbitrator by CSEA, within five (5) days the Assistant

17

Superintendent, Human Resources, shall request a list of five (5)

18

available arbitrators from the State Mediation and Conciliation Office

19

and submit same to the grievant. The District and the Association will

20

alternately eliminate names from the list until one name remains and

21

the name thus remaining shall become the arbitrator. The party who

22

shall eliminate the first name shall be determined by lot unless a

23

different process is mutually agreed to by both parties.
