CSEA Collective Bargaining Agreement

ARTICLE XVI: LAYOFF AND REEMPLOYMENT 1 The District may layoff or reduce hours of unit members for lack of work and/or lack of funds 2 pursuant to Education Code section 45117, as amended, providing the following procedures are 3 followed 4 16.1 Review - The District and Association officers shall meet within fifteen (15) days prior to 5 the receipt of any notices of layoff to review the proposed layoff and the order of layoff within 6 the provisions of this Agreement. The Association shall at this time receive a seniority list of unit 7 members in all classifications in which layoffs are contemplated. 8 16.2 Order of Layoff 9 16.2.1 Whenever a member of the bargaining unit is laid off, the order of layoff within 10 the member's classification shall be determined by date of hire. The member who has 11 been employed the shortest time in that classification, plus higher classifications, shall be 12 laid off first. 13 16.2.2 If two (2) or more classified employees subject to layoff have equal length of 14 service, the determination as to who shall be laid off shall be made by lot. 15 16.2.3 The length of service in the District shall be computed by years of service from 16 the date of hire as a regular classified employee, excluding overtime and leave for 17 personal reasons. 18 16.2.4 Substitute and/or short-term service shall not be considered in determining 19 seniority. 20 16.3 Displacement Rights A member of the bargaining unit laid off from their present 21 classification has displacement rights into the next lower classification in which the 22 member has greatest seniority in that classification. A member who elects a layoff in lieu 23 of bumping maintains their reemployment rights under this Agreement. 24
