16.2.5. Responsible Parties

The owner, developer, tenant, or occupant of any land or structure, financial responsible party, and an architect, engineer, builder, contractor, agent, or any other person who participates in, assists, directs, creates, or maintains a situation that constitutes a violation of this Ordinance. All persons who commit violations shall be held responsible and shall be subject to the remedies and penalties set forth in this Chapter.

16.3. Enforcement Responsibility And Procedures

16.3.1. Responsibility for Enforcement A.

Primary responsibility for enforcing the provisions of this ordinance shall be divided among Town officials as follows: 1. The Planning Director, or his/her designee, shall be responsible for all enforcement of the zoning and subdivision provisions in the text of this Ordinance, zoning district boundaries, and compliance with conditions of approval. 2. The Engineering Director, or his/her designee, shall be responsible for enforcement of the watercourse buffers, erosion control, floodplains, stormwater management, illicit discharges, and engineering provisions in the text of this Ordinance and compliance with conditions of approval. B. The Building Official, or his/her designee, is responsible for all enforcement of Building Code. C. All other officers and employees of the Town, especially members of the Police Department and Fire Department, shall have the duty to assist in enforcing this Ordinance by reporting apparent violations of this Ordinance to these officials.

16.3.2. Complaints Regarding Violations

In addition to enforcement by Town officials, any person may submit a complaint alleging a violation of this Ordinance. On receiving a complaint that fully states the basis for the allegation, including the apparent cause of the alleged violation, the Planning Director, Engineering Director, or Building Official, as appropriate, shall properly record such complaint, investigate the alleged violation, and take appropriate action as provided by this Ordinance. After presenting proper credentials, the Planning Director, Engineering Director, and/or Building Official may enter upon land or inspect any land or structures to ensure compliance with the provisions of this Ordinance. These inspections shall be carried out during normal business hours unless the Administrator determines there is a special circumstance or an emergency necessitating inspection at another time. Inspections of non-public areas may only occur with the consent of the premises owner or with an administrative inspection warrant. B. No person shall willfully resist, delay, or obstruct an authorized representative, employee, or agent of the Town of Wake Forest while that person is inspecting or attempting to inspect land or structures nor shall any person obstruct, hamper, or interfere with any such representative while in the process of carrying out their official duties.
