Numerous bills sponsored by the Ohio Chamber of Commerce were passed by the Ohio General Assembly, all with the intention of making Ohio the most business- friendly state. LEGISLATIVE ACCOMPLISHMENTS

With seven on-staff registered lobbyists and a team that includes a former Congressman, a former State Senator and a former Member of the Ohio House of Representatives, the Ohio Chamber of Commerce has the knowledge and experience to tirelessly advocate for our members each day at the Ohio Statehouse. We've seen numerous successes at the Statehouse in the 135th General Assembly that add up to over $9 billion in savings for Ohio businesses. The Ohio Chamber loudly championed legislation to help the business community and fiercely opposed measures that would have hurt businesses and jobs.

135 TH GENERAL ASSEMBLY ACCOMPLISHED POLICY PRIORITIES ✓ JobsOhio Extension Language (Enacted through House Bill 33 – State Operating Budget) • A budget amendment conceived by the Ohio Chamber to eventually extend JobsOhio’s liquor franchise by 15 years. • Equips JobsOhio with increased capacity to compete for more economic opportunities, longer-term agreements, and more aggressive incentives. • Blueprint reference: Taxes & Costs, Pg. 52, Recommendation 1.2 ✓ Senate Bill 1 / House Bill 12 (Enacted through House Bill 33 – State Operating Budget) • Restructuring of both the Ohio Department of Education and the State Board of Education to provide stronger emphasis on workforce skills and career readiness. • Blueprint reference: Education & Workforce, Pgs. 28-30, Recommendations 2 & 4 ✓ Innovation Hubs (Enacted through House Bill 33 – State Operating Budget) • $125 million to convene Innovation Hubs (modeled after Innovation Districts) in multiple mid-sized Ohio metropolitan centers, and in cooperation with regional business, higher education, and economic development partners, fully unlocking the potential of unique high-growth opportunities in various key industries. • Blueprint reference: Innovation and Collaboration, Pg. 56 & Pg. 61, Recommendation 2.1 ✓ Ohio Workforce Housing State Tax Credit Program (Enacted through House Bill 33 – State Operating Budget) • Creation of a state low-income housing tax credit program to develop approximately 4,700 affordable housing units over four years and allow Ohio to potentially draw down federal bond volume cap for multifamily development. • Blueprint reference: Sense of Place, Pg. 41, Recommendation 1.1.2 ✓ Streamlining of Ohio’s Administrative Code (Enacted through House Bill 33 – State Operating Budget) • Reduction of up to 1/3rd of Ohio Administrative Code through the targeting of duplicative provisions, outdated sections, and unnecessary requirements. • Blueprint reference: Business Friendliness, Pgs. 65 & 69, Recommendations 1 & 2 ✓ Promotion of Computer Science/STEM Offerings at the K-12 and Post-Secondary Education Levels (Enacted through House Bill 33 – State Operating Budget) • Adoption and funding of key recommendations by the State Committee on Computer Science to make Ohio a national leader in Computer Science education and create a technological workforce pipeline. • Blueprint reference: Education & Workforce, Pg. 30, Recommendation 4.2 ✓ Age Extension for Medicaid Buy-In for Workers with Disabilities (MBIWD) Program (Enacted through House Bill 33 – State Operating Budget) • Removal of the age cap for the Medicaid Buy-In for Workers with Disabilities Program. • Addressing this benefit cliff allows disabled Ohioans 65 and older to continue working, earning a living, and paying a monthly amount to receive their needed Medicaid coverage. • Blueprint reference: Education and Workforce, Pg. 27, Recommendation 1.3 ✓ State Mineral Leasing Within Tier I & Tier II Lands (Enacted through Ohio Administration Rule 1501:155-1-01) • Adoption of an administrative rule to create a standard lease agreement allowing mineral leasing on state lands, with most projects involving no surface impact to public lands, unleashing more economic opportunities for Ohioans and providing additional energy security for Ohio and the United States. • Blueprint reference: Infrastructure, Pg. 77 & 83, Recommendation 1.2

JobsOhio Extension Language A major initiative the OCC both proposed and facilitated was an amendment to eventually extend JobsOhio’s liquor franchise by 15 years. JobsOhio currently has 15 years remaining on its original 25-year franchise, and this extension will equip JobsOhio with increased capacity to compete for more economic opportunities, longer-term agreements, and more aggressive incentives. Under this language, the state and JobsOhio will now enter into an extension agreement which must then be approved by the State Controlling Board.

Commercial Activity Tax (CAT) Exemptions At the request of Ohio Senate leaders, the OCC was asked to weigh in on their proposal to cut the Commercial Activities Tax (CAT). The OCC suggested an approach, which was ultimately adopted, of a phased exemption from the CAT for taxable gross receipts of $3 million or less in FY24, and taxable gross receipts of $6 million or less in FY25. The exemptions will provide tax relief to all businesses paying the CAT and, when fully implemented, will eliminate the CAT for approximately 90% of all Ohio businesses, or 145,000 of the current 163,000 CAT payers. The Legislative Budget Office projects the exemptions will reduces CAT receipts by about $238 million in FY24 and $460 million in FY25, amounting to $698 million total in CAT tax relief over the biennium.

IMPORTANT NOTES: Business impact calculations are based on fiscal impact estimates of the Legislative Service Commission, independent studies, other available data and research materials, and Ohio Chamber analysis. Business impact per employee is calculated by using the estimated number of employed workers statewide in September 2023 (5,618,992).

MEMBER PROGRAMS

Workers’ Compensation Savings

Members of the Ohio Chamber of Commerce Workers' Comp program saved a total of $11,669,110 in 2023.

Ohio Chamber Health Benefit Program

The Ohio Chamber of Commerce Health Benefit Program (Ohio MEWA), administered by UnitedHealthcare, provides small businesses healthcare focusing on access to care, quality of life care, affordability of care and providing healthier outcomes. During 2023 the MEWA gained over 6,000 new insured individuals for a total of 24,419.

Ohio Chamber Business Academy

The Ohio Chamber of Commerce hosted 15 Business Academy webinars in 2022, with over 1,000 attendees. We offered free CLE, CPE, SHRM & HRCI or a combination of those credits for each webinar. We brought in experts in their fields and covered topics including employee wellness, tax issues, DEI, workplace harassment and more. We look forward to continuing to expand this program in 2024.

OHIO CHAMBER ACTION NETWORK In 2023, the Ohio Chamber of Commerce started the Ohio Chamber Action Network (an affiliate of the Ohio Chamber of Commerce) to build an army to help us defend the free market and capitalism to benefit all Ohioans. This network is a new Ohio Chamber effort that will ensure we stand strong against job-killing, anti-business interest groups and their bad ideas.Together, we will begin to save Ohio’s economy. But we can’t do it without your help.

HEALTHCARE PARTNERSHIPS This year, the Ohio Chamber Health Benefit Program (OCHBP) partnered with AndHealth, a leading digital health company, to offer care for high-cost autoimmune conditions to the 20,000 members of the small-business-focused program that is sponsored by the Ohio Chamber of Commerce. AndHealth helps people with complex chronic diseases through its participatory model that combines specialty care with support for behavioral health and lifestyle factors, helping patients regain their health. The OCHBP’s partnership with AndHealth builds toward the Ohio Chamber’s Blueprint for Ohio’s Economic Future—to accelerate the advancement of healthcare delivery and improve health outcomes. FUNDING FOR CLEAN HYDROGEN HUB

In October, Ohio Chamber CEO Steve Stivers thanked the U.S. Department of Energy (DOE) for selecting the Appalachian Regional Clean Hydrogen Hub (ARCH2) for up to $925 million in federal support under the Bipartisan Infrastructure Law. The Chamber was a vocal proponent of the ARCH2 project receiving funding. Its letter of support can be found HERE. The federal infrastructure law included $8 billion for regional clean hydrogen hubs to spur the production, transport and use of clean hydrogen across the nation. The primary objective of the ARCH2 program is to enable widespread deployment of infrastructure for clean hydrogen production, transport and end- use in the Appalachian Basin states of Ohio, West Virginia, Kentucky and Pennsylvania and adjacent eastern and midwestern states. The Hub is projected to create over 20,000 jobs in our region. Additionally, the $925 million in federal funding is expected to also generate up to $6 billion in additional private sector matching funding.

OHIO CHAMBER BRINGS THE VOICE OF OHIO’S BUSINESS COMMUNITY TO COURTS ACROSS THE COUNTRY

In 2023, the Ohio Chamber of Commerce carried on with its legal defense fund that was implemented in 2022. The Ohio Chamber also added additional legal programs highlighted below. The Ohio Chamber filed 18 different amicus briefs in courts across the country, including two at the US Supreme Court. The Ohio Chamber also filed a lawsuit directly along with the US Chamber of Commerce to fight the drug price scheme contained in the Inflation Reduction Act. The Ohio Chamber’s amicus brief program highlights the voice of the Ohio business community. These significant cases impact employers in every industry and at all sizes, because a wrong decision from the court can increase operating costs for employers and create more regulatory unpredictability. The Ohio Chamber joined two cases at the US Supreme Court to bolster arguments for the reform of the Chevron Doctrine. Chevron reasoned that administrative agencies had expertise on specific matters and would be best positioned to interpret ambiguous or unclear legislation. The Ohio Chamber is arguing that Chevron impedes the role of the judicial branch to clear up ambiguous legislation. The Ohio Chamber also implemented a program for small business members contacted by the IRS regarding the Employee Retention Tax Credit. Finally, considering the passage of Issue 2, the Ohio Chamber conducted a webinar on employer rights followed by materials to consider when implementing HR policies to address the fact that adult marijuana use is now legal in the state of Ohio.

CRIME TASK FORCE

In June of this year, the Ohio Chamber formally rolled out its Crime Task Force, aiming to address the issues and responses raised in the survey and discuss possible solutions to increase security and growth of Ohio businesses. Based on the survey’s findings, the Task Force focused first on the issue of retail theft. The U.S. Chamber of Commerce reported that a total of 3.59% of all U.S. retail crime in 2021 took place in Ohio. The Task Force pulled together representatives of the retail community along with state and county law enforcement officials and was led by former U.S. Attorney David DeVillers of Barnes & Thornburg LLP and retired Judge Scott VanDerKarr. The group met periodically throughout the summer and early fall to discuss criminal justice reforms, prosecutorial authority, and new or enhanced penalties to produce recommendations for the Ohio General Assembly.
