LSMS TURNS THE PAGE In the works since 2019, Louisiana State Medical Society looks to the future as we move to our new location by year’s end.

LSMS TURNS THE PAGE 6767 Perkins Road, also known as Perkins Properties, has been the home of the LSMS and CSRS (an engineering firm) since they joined in partnership and began construction of the building in 1996. For almost 25 years, the LSMS has called 6767 its home. During that time, our footprint and faces changed many times, but we always occupied suite 100 (the first floor). Starting with Bruce Williams, MD, and ending with William Freeman, MD, the boardroom has seen many presidents preside over meetings of the Board of Governors. The halls and offices were occupied by many qualified and passionate staff members during those 25 years as well.

WE NEED YOUR HELP!

However, just as all goods things must come to an end, so must our ownership and occupancy in Perkins Properties. A move, to a smaller and more efficient location has been in the works since 2019 but was delayed dramatically due to the COVID-19 pandemic. Things are finally getting back to normal and just as life, the business of the society must go on. To that end, after CSRS moved to a larger location in September, a purchase agreement to sell the building and adjacent property was entered into in October. The next and final step is for the LSMS to move, and we anticipate that will conclude before the year’s end. Please be on the lookout for our new mailing address, which we will share very soon.

• Traumatic Head and Spinal Cord Injury Trust Fund AdvisoryBoard This board was created by the Louisiana Legislature in 1993 by Act 654, which imposes additional fees on motor vehicle violations in Louisiana for the offenses of driving under the influence, reckless operation, and speeding. • Louisiana Commission on HIV, AIDS, and Hepatitis C Education, PreventionandTreatment This commission was created to serve as an advisory body to the governor and the Louisiana Department of Health on matters relating to hepatitis C, HIV, and AIDS. The American Medical Society’s (AMA) House of Delegates met this week, and while Louisiana does send a delegation to the meeting, via the LSMS, it is important for Louisiana physicians to know that the LSMS and the AMA are separate and distinct organizations. As such, the policies, opinions, and views expressed by the AMA, the AMA House of Delegates, and AMA officers are theirs and theirs alone. Dr. Myra Kleinpeter, a practicing nephrologist in New Orleans has been appointed to the LSMS Board of Governors as the District 1 Councilor. The first district includes Orleans and St. Bernard parishes. Dr. Kleinpeter has been an active LSMS member for more than 25 years.

IN CASE YOU MISSED IT Louisiana Attorney General, Jeff Landry, filed suit challenging the COVID-19 Vaccine Mandate On Tuesday, November 16, 2021, Louisiana Attorney General, Jeff Landry filed a lawsuit challenging the legality of the Centers for Medicare and Medicaid Services’ rule mandating COVID vaccines for nearly every full-time employee of healthcare facilities receiving Medicaid or Medicare funding. Landry asserts that the mandate will upend the state budget and create healthcare shortages. The complaint was filed in federal court in Louisiana by a 12-state coalition including Montana, Alabama, Arizona, Georgia, Idaho, Indiana, Louisiana, Mississippi, Oklahoma, South Carolina, Utah and West Virginia.

complaints, and the Gross Negligence Doctrine. There was significant discussion relative to the letter, which can be viewed below, sent by the Louisiana Association for Justice to medical review panel chairs stating that they are not inclined to use attorney chairpersons who intend to allow the medical review panels to apply the qualified immunity provisions of the Louisiana Health Emergency Powers Act, La. R.S. 29:771(B)(2)(c) as well as current efforts to seek a ruling that the panel chairs must instruct the panelists in the modified gross negligence standard under the LHEPA.

Dear Attorney Chairperson,

As you know, Governor John Bel Edwards declared a public health emergency for the entire State on March 11, 2020. The public health emergency has been extended multiple times and is still in effect. In 2003, the Legislature enacted a body of!aw authorizing the governor to declare public health emergencies and in that law is a Section that purports to grant qualified immunity to health care providers during a public health emergency. Specifically, La. R.S. 29:771.B.(2)(c)(i) originally provided that: "During a state ofpublic health emergency, any health care providers shall not be civilly liable for causing death of, or injury to, any person or damage to any property except in the event of gross negligence or willfol misconduct." In October 2020, the law was amended to read as follows: "During a state of public health emergency, no health care provider shall be civilly liable for causing the death of, or injury to, any person or damage to any property except in the event of gross negligence or willful misconduct." You will note that Title 40 is not referenced in the law. You will also note that "patients", "medical care or treatment", and "medical review panels" are also not mentioned in the miscellaneous provision. He also reviewed a case study of the Lafayette Parish Health Equity Task Force.

Since the start of the new program year, the LSMS has hosted several GME lectures for the residents and fellows at Ochsner Medical Center. This educational partnership was established in 2000 to elevate their learning experience and inform them to the benefits of the state medical society.

LSMS Vice President of Governmental Affairs, Maria Bowen, and LSMS Vice President of Administration and Member Services, Terri Watson, attended the St. Tammany Parish Medical Society meeting on November 3rd. Maria reviewed the 2021 legislative session and discussed LSMS regulatory efforts. She also shared with attendees her thoughts on what physicians could be facing in the 2022 legislative session and asked for feedback on how LSMS can help them. Attendees discussed various legislative

issues and shared experiences about attending White Coat Wednesday and the legislative reception. Chris Foret, MD, LSMS appointee and chair of the Patients Compensation Fund, shared additional information on the PCF and encouraged members to get engaged. Terri ended themeetingwith an update on the development of the LSMS Multiple Employer Welfare Arrangement which will utilize the most popular plans offered by BCBSLA, the newly designed Capsules and the Group Purchasing Plan.
