PREPARATION IS ESSENTIAL

And that is why I succeed.” –Michael Jordan When I first started out as a lawyer, my bosses handed me cases that no one else wanted to handle, either because the case was too small or the case was going to be very difficult to win. The lawyers above me didn’t want to handle the losing case. It was easier to give it to the new guy, so I handled a lot of those “loser” cases. Sometimes I was given a case in which all of the pretrial work was done, and I would just have to go try the case. As such, I inherited the work of another lawyer who maybe did not believe in the case and didn’t do all that was necessary to win. I didn’t like losing whatsoever. That early experience taught me very important lessons on how to prepare winning cases. As an athlete, I was trained to try and win every race, even when the odds were stacked against me. The more I prepared a case, the more I won those cases. Every professional athlete will tell you that the No. 1 reason for their success is their fanatical preparation. The No. 2 reason the great ones succeed is they are not afraid to lose. The reason why Michael Jordan could hit those clutch jumpers everyone remembers in the playoff was because he was fearless in taking the last shot. Athletics also taught me how to react when I lost races. As such, I had been hard-wired to be unafraid of losing. In this mindset, you shouldn’t be afraid of losing. You should be afraid of not putting forth your best effort in the race, or in your case, in this situation. This is a terrific quality for anyone in any line of work. In our work here, it is essential. Our people want to win. They don’t focus one bit on the fear of losing. As we handle your case, our job is to see the end of your case and prepare for that day with fanatical precision. In your case, we are only required under the law to prove the case against the insurance companies by the preponderance of evidence.

That is, we only need to prove that it is more likely than not that the insurance company defendant was at fault and that fault damaged you. Here, we have trained our team to build your case to win beyond any doubt. But we need your help. WHAT TYPES OF MESOTHELIOMA COMPENSATION Are Available to Victims?

Asbestos is a well-known hazard now, but it wasn’t several decades ago. Exposure to asbestos, even if it was many years ago, puts you at increased risk of lung disease. Asbestos-related conditions include mesothelioma, lung cancer, and asbestosis. Of the three, mesothelioma is the most aggressive — and deadly. Mesothelioma is a type of cancer which occurs and develops in the thin layer of tissue called mesothelium that covers your internal organs. It often affects the tissue around the lungs. Common signs of this disease include chest pain, painful coughing, shortness of breath, and unexplained weight loss. By the time most mesothelioma patients go to the doctor, it’s too late. Many folks who are diagnosed with mesothelioma were exposed to asbestos years ago on the job, and they didn’t know. Mesothelioma has a latency period of 20 to 50 years. Mesothelioma victims and their families filed several lawsuits. To this day, there are thousands of mesothelioma lawsuits pending across the country. In

mesothelioma claims, there are at least three avenues to compensation: asbestos trust fund claims, settlements, and lawsuit verdicts. An attorney can help figure out which ones you qualify for. Asbestos Trust Funds Bankrupt asbestos companies created asbestos trust funds. These funds provide compensation for current and future claims. In order to be eligible to file an asbestos trust fund claim, an individual must identify when they were exposed to asbestos by a corporation and when they developed an asbestos-related illness, such as mesothelioma, lung cancer, or asbestosis. Mesothelioma Settlements Mesothelioma settlements happen when the asbestos defendant offers compensation to the plaintiff to resolve the claim. Most of the time, companies will offer to settle the claim before trial. Mesothelioma Lawsuits Mesothelioma claims can resolve at trial as well. After the trial has concluded, a jury determines liability and awards the plaintiff damages. The amount awarded is

decided by economic and noneconomic losses suffered by the plaintiff.

Economic damages include past and future lost wages as well as past and future medical bills. Noneconomic damages are intangible. They include compensation for pain and suffering, disability, disfigurement, and loss of a normal life. The jury may also award punitive damages, which are intended to punish the defendant for their reckless behavior. Other Mesothelioma Claims Mesothelioma patients and their families may also be eligible for other types of compensation, including workers’ compensation claims and veteran’s claims.
