April/May 2020

TO OUR VALUED CLIENTS, PARTNERS, COLLEAGUES, FRIENDS, AND FAMILY

As you all realize now, the COVID-19 virus is impacting everyone’s life. Like all of you, everyone at the Kanter Law Firm is concerned about the effect this will have on people not only in our local community, but our state, our country, and the rest of the world. Although there is a closure of most state courts and limited activity in the federal courts, my office is fully open and operational. Even though my entire staff is working remotely, we have been set up for this for a couple of years. We have daily video meetings to make sure our clients and their needs are continually taken care of. For new

clients, even though we can’t meet in person at the present time, we will use current technology to meet via video and, of course, by phone. Email is always a good way to communicate and send documents. Again, since the state courts are closed, we will let you know when your canceled court date is rescheduled. For future court dates, there may be changes. Nonetheless, we will keep our clients up to date on their hearing dates. If you have left us an email, that will be utilized first with a request to have the email acknowledged.

As always, all of us at the law firm wish and pray for everyone’s health and welfare. Your business and patronage is always appreciated. Please do not hesitate to contact us with any questions or concerns in this unique and uncertain time.

The best to all,

-Elliott Kanter

SAVE THE PLANET WITH YOUR PLATE THE TOP 3 WAYS TO EAT ECO-FRIENDLY

Can your diet save the planet?

can offer a combination of proteins that are as complete and healthy as beef or chicken.

based diet one day a week or eliminating meat from one meal a day is a great way to reduce meat consumption. GO FLEXITARIAN If you want to eat more vegetarian meals but find animal products are too hard to give up, going flexitarian is a good compromise. A flexitarian eats mainly plant-based dishes but also includes a modest amount of poultry, fish, milk, and eggs with a limited amount of red meat. If you’re able to dedicate even just one week to trying a plant-based diet, it can help you get a feel for if you’re capable of making the switch. You may even realize that it’s not hard to change your diet, and you might find it fun to try a whole different range of flavors through vegetarian food as you “reinvent” your favorite meaty dishes.

It can be difficult to see the connection between your plate and the planet, but scientists say that eating less red meat and processed foods can greatly reduce your environmental impact. About 25% of climate change today is fueled by agriculture and factory farming, particularly the large quantities of the greenhouse gas methane that cows produce. This means that the fewer animal products you consume, the more sustainable your diet will be. Producing and packaging beef is 100 times more emissions-intensive than producing legumes. While a lack of protein is a common concern about plant-based diets, many dietary experts say that plant- based diets can meet nutritional needs. Also, proteins aren’t the only nutrient your body needs, and dozens of vegetables and starches

With April being Keep America Beautiful Month, here are some eco-friendly diet adjustments anyone can make to help preserve the planet. EAT PLANT-BASED DIETS The main goal of a plant-based diet is to replace animal products as the centerpiece of the meal. At least three-fourths of your meal should be vegetarian, but you don’t necessarily need to cut meat out altogether. For example, eating a Mediterranean diet can be very sustainable. Red meat is rare, and there’s a strong focus on legumes and vegetables. ADOPT MEATLESS MONDAYS OR MORNINGS If you’re not ready to commit to a plant-based diet, going vegetarian one day a week can be a great option. Adopting a plant-

ARREST FAQS THE MOST COMMON QUESTIONS AFTER A FIRST ARREST Most people don’t plan on ending up on the wrong side of the law. So, when a misunderstanding or life circumstance suddenly has you facing a criminal charge, it can be difficult to know what to do. As a firm protecting clients’ rights since 1980, we’ve answered many questions from people blindsided by their first arrest. So we’d like to address a few of the most common concerns we hear. WHAT SHOULD I DO AFTER AN ARREST? Exercise your right to remain silent. This could not be more critical regardless of the nature of your case. Simply provide law enforcement with basic information, and calmly explain that you will not speak to any officers until your attorney is present. Then, the moment you are allowed to make a phone call, get an experienced San Diego criminal defense attorney to represent you. CAN I DEFEND MYSELF? Representing your own case is never recommended. Attorneys spend years studying their chosen area of the law for a reason — it’s a complex subject. Without this background knowledge, facing a seasoned prosecution team will prove almost

impossibly difficult. You might not only be found guilty but also miss your chance at a plea bargain.

WHAT IS A PLEA BARGAIN? A plea bargain is an agreement made between a defendant and a prosecutor. In exchange for you not contesting the charges, the prosecution will recommend a lighter sentence or even reduce the charges to a lesser crime. It’s the duty of a defense attorney to negotiate these bargains and present you with an objective view on whether or not taking this deal is better than fighting the charges. HOW MUCH DOES GETTING A LAWYER COST? In criminal defense, lawyers base their rates on the complexity of the case. For example, a federal charge will generally take more preparation and court appearances than a misdemeanor and, therefore, will cost more. At the Law Office of Elliott Kanter, we’ll review the details of your case and let you know what the appropriate legal fee should be.

DO I HAVE A CASE?

Evaluating Your Personal Injury Claim

“Do I have a case?” It’s one of the most common questions personal injury attorneys hear, and that’s understandable. When you’ve been seriously harmed, you can be faced with a mountain of medical bills, a long recovery process, and perhaps even a loss of function for the rest of your life. It’s natural to want the party responsible for your injury to cover these costs. But often, determining fault isn’t straightforward. Here are things to consider before pursuing a claim.

DO YOU HAVE EVIDENCE?

Often determining fault for even the most straightforward of accidents hinges on a few key details. But when those facts are up for debate — your word versus the word of the person who injured you — your claim can be in jeopardy. Ideally, you should take pictures, talk to witnesses, and get a police report at the time of the accident. Of course, a skilled personal injury attorney may also be able to bring in accident reconstruction specialists and other experts to help your case after the fact.

WHAT PARTIES WERE INVOLVED?

Sometimes identifying the real person at fault isn’t as simple as exchanging information with the person who rear-ended you. What if you’re injured while riding in an Uber or by a piece of equipment in a building that wasn’t maintained, like a malfunctioning automatic door? It can be hard to point a finger at the party most at fault in these instances. That’s why expert attorneys delve deep into the details of your case to find all the relevant parties involved.

While the kids hunt for Easter eggs in the yard, whip up this easy deviled egg recipe for a hearty snack that’s sure to satisfy any craving.

INGREDIENTS

• • • • • •

1/2 cup mayonnaise

Salt, paprika, garlic powder, and pepper, to taste

2 tbsp milk

1 tsp dried parsley flakes

• •

12 large eggs, hard-boiled

HAVE YOU SOUGHT MEDICAL TREATMENT?

1/2 tsp dill weed

Fresh parsley, minced, and paprika for garnish

1/2 tsp fresh chives, minced 1/2 tsp ground mustard

Making expensive healthcare visits in the wake of an accident can be hard, especially if you don’t know if you have a claim or not. But the best thing you can do in these situations is make sure a medical professional cares for you. This will not only prevent your condition from worsening but will also strengthen your case. Failing to seek treatment gives the insurance company an avenue to argue that your injuries are not as bad as they actually are. When it comes to a personal injury case, not going to the doctor can actually cost you money.

DIRECTIONS

1. In a large bowl, combine mayonnaise, milk, parsley flakes, dill, chives, mustard, salt, paprika, garlic powder, and pepper. Mix well and set aside. 2. Cut eggs lengthwise and remove yolks carefully to preserve egg whites. 3. In a small bowl, mash yolks. 4. Mix mashed yolks with mayonnaise mixture. 5. Spoon or pipe the mixture back into the egg whites. 6. Garnish with fresh parsley and paprika. Refrigerate before serving.

LAUGHTER YOGA’S RISE AS A GLOBAL HEALTH MOVEMENT

LAUGH WITH ME!

We’ve all heard that laughter is the best medicine, and it turns out that human physiology supports this claim. When we laugh, our body releases a flood of feel-good chemicals and neurotransmitters. Our blood flow increases, and our production of cortisol, a hormone associated with stress, decreases. Oh, and laughing also burns calories! The feel-good, endorphin-inducing benefits of laughter are exactly what prompted Dr. Madan Kataria to develop laughter yoga in 1995. Laughter yoga incorporates breathing, stretching, clapping, and of course, laughing. Kataria developed the initial idea after coming across research into the benefits of laughter on overall health and well-being. He began to put the research into practice by telling jokes to his patients, and after seeing the positive effects, he took his material to a local park. Parkgoers, who were initially skeptical, joined in on the practice, and the first laughter yoga club was born.

The laughter meetup had everyone in high spirits — until the group ran out of jokes. Unsure of what to do next, Kataria found another medical book suggesting the group didn’t need jokes to laugh. Fake laughter is just as beneficial as the real thing because the body can’t tell the difference between the two. Collaborating with this wife, Madhuri, Kataria combined common yoga warmups and breathing techniques with facilitated laughter to create the form of laughter yoga that is practiced worldwide today. If you’re interested in trying laughter yoga for yourself, then you’re in luck. Laughter yoga clubs exist across the United States and the world. Videos on YouTube can teach the basics, but laughter yoga tends to be most beneficial in a group setting. Just think about the last time you found yourself in a fit of giggles with a group of friends or during a comedy show. Didn’t it feel great? Rather than wait for a silly situation to trigger laughter, use laughter yoga to promote laughter and alleviate stress on any day at any time.
