Personal Leave of Absence For other types of leave or for leaves not eligible for FMLA, such as education or an extended leave when FMLA has expired, employees may request a personal leave of absence for up to 90 days. No benefits accrue during a personal leave. Employees may obtain continuation of group health coverage as provided for under COBRA which is described previously in this Handbook. The Village does not guarantee that you will be placed back in your original position, or any position, upon return from personal leave. Employees who have not been reinstated into a position will generally be removed from the payroll after 90 days from the start of their leave. However, if upon expiration of the leave an employee is unable to return because of a medical condition, VOP will enter into an interactive discussion with the employee to determine if additional leave is reasonable. Military Leave Employees are entitled to such military leave, reinstatement and re-employment as is required by state and federal law. Regular staff members who are active members of the National Guard or Reserves with a minimum of six months of service with the Village of Pinehurst are eligible for military pay differential up to 12 months. This differential is calculated as the difference between the employee’s normal base pay and the pay received for military duty. If military pay is more than the amount of pay the employee would have received working at the Village, there will be no pay differential. Employees may also continue insurance coverage during the eligible military leave. The Village will continue to pay the employer portion of the premiums for the same time as an employee on a temporary medical leave. The employee would continue to pay the employee portion monthly. At the end of the Village’s obligation, the employee and dependents will have the opportunity to continue the coverage. Refer to the Military Leave of Absence Policy for more information. Parental Leave As required by NC law, parental leave is available to employees who are parents/guardians or a person standing in loco parentis (in place of the parent) to be involved in a child’s school activities. Up to four hours of unpaid leave may be granted annually, subject to the following conditions: 1. The leave must be taken at a time mutually agreed upon by the employee and the supervisor; 2. The supervisor may request written verification from the child’s school that the employee was involved at the school during the leave time granted. Nursing Mothers in the Workplace The federal Fair Labor Standards Act (FLSA) allows team members to take reasonable break time to express breast milk as needed for up to one (1) year after the birth of a child. VOP will provide a place for the team member to express breast milk, other than a bathroom, that is shielded from view and free from intrusion from co-workers and the public. Employees will not be discharged or in any other manner discriminated against by exercising their rights under this policy. Team members with further questions or concerns regarding this policy should contact their supervisor or the Human Resources Department.
