Social security coordination arrangements between the UK and the EU from January 2021 16 November 2020

New guidance has been published, which details what the social coordination arrangements between the UK and the EU will be under the EU Withdrawal Agreement from 1 January 2021.

The guidance is aimed at those who work in the Department for Work and Pensions (DWP), HM Revenue & Customs (HMRC) and the Department of Health and Social Care. It should be used from 1 January 2021 upon consideration of an application for a social security benefit or pension from:

• A UK national living in the European Economic Area (EEA) or Switzerland • An EEA or Swiss national living in the UK

Guidance is split into three chapters:

• Chapter one – discusses the determination of those who are covered by the provisions of the social security coordination Title of the Withdrawal Agreement, and determining their rights under these provisions • Chapter two – discusses the citizens’ rights provisions in Part Two of the Withdrawal Agreement as they relate to social security coordination and provides examples as an aid to interpretation • Chapter three – gives a summary of the EU Regulations on social security coordination to assist with comprehension of the guidance on implementation of the Withdrawal Agreement

The Withdrawal Agreement can also be accessed in full here.
