Burke Warren attorneys Chris Kentra and Blake Roter won summary judgment in a $12 Million insurance recovery action which was affirmed on appeal this year in Axis Surplus Ins. Co. v. Allied World Assur. Co. , 2025 IL App (1st) 240964-U. The dispute arose after our client’s insurers denied that they had a duty to defend and indemnify an additional insured under primary and excess CGL policies relating to a construction accident. The Circuit Court of Cook County, Illinois granted summary judgment in favor of our client and its additional insured, which resulted in an additional $12 Million in insurance proceeds being available to resolve an underlying personal injury matter. The Circuit Court was then affirmed by the Illinois Appellate Court, First District. Burke Warren’s Insurance Recovery Practice Group represents policyholders in insurance disputes in state and federal courts across the country.
