Consideration of Placement of Capital Improvement Expenditure on Ballot

Background: ORPS’ CC&R’s and Californoa Code require that any capital expenditure for new facilities which is in excess of 5% of the Annual Budget must be approved by a vote of the membership. The date of record for ownership is Feb 5 and the ballots are expected to be mailed shortly thereafter. The proposed motion below will authorize the Inspectors of Elections to place the Pickleball Noise Absorption Project on the ballot. The figure of $500,000 proposed for the ballot is believed to provide a cushion and the period between now and the mailing of the ballots will be used to obtain preliminary engineering work, more refined price estimates, and consideration of funding arrangements. This additional information will be communicated to the members to assist in their decision to either approve or disapprove the project. At this time, we are merely deciding to put the proposition on the ballot. After the Owners approve the expenditure, later decisions by the Board will entail obtaining Cathedral City approvals, soliciting bids from material suppliers and construction contractors, and then awarding contracts for construction, with expected completion of the project by October of 2021. Motion for Consideration: To place on the Ballot of the upcoming Board of Directors Election a vote for the Membership to approve or disapprove an expenditure of up to $500,000 of Capital Improvements to adopt the recommendation of Spendarian & Willis, LLC and install approximately 800 linear feet of noise-absorbing wall having a Noise Reduction Coefficient of at least .90 at frequencies of 1000 Hz, 2000 Hz and 4000 Hz Designated Funding: N/A
