3 Common Practices that Place Your Entire Real Estate Portfolio at Risk

GARRETT SUTTON Founder of Corporate Direct

• Do you own real estate in your own name (even your personal residence)? • Have you ever been dissatisfied with unprofessional work from a real estate contractor or service provider? • Have you put off setting up business entities to protect your assets from lawsuits and litigation? Or, have you failed to maintain any entities you do have? If the answer to any of these questions is “Yes,” then you are at risk in our ever-increasing litigious society. Here’s a nasty little secret most lawyers won’t tell you: No lawyer ever takes a case without doing their own “due diligence” on that case in advance. If the odds do not look good or the “payoff ” is not sufficiently attractive, it doesn’t matter how good of a person you are or how unjustly you have been treated. Most lawyers won’t take you on as a client. That is true for every legal practice , but it is particularly true for lawyers who specialize in lawsuits designed to garner their clients big financial settlements. It’s also why if you own your own home in your own name (much less other invest- ment properties), have set up LLCs or other business entities incorrectly to inadequately shield your company’s true net worth or your own, or have ever tangles with a contractor or service provider who did not provide acceptable service on an investment property… …You are at risk every time a lawyer does due diligence on you. Furthermore, do not think for one minute that if you are a real estate investor, someone is not doing their due diligence on your worth. If fact, they’re probably doing it right now. Fortunately, there are some really simple adjustments that you can make your existing real estate business structure to create massive fortifications against anyone who wants to know, well, anything, about your value of your assets. Let’s look at another set of questions: • Do you have an inexpensive umbrella insurance policy with a mega-payoff in place?

• Does each of your properties have its own LLC in its own state? • Are those LLCs owned by another corporation in a certain state out west (and no, it’s not Nevada)? If the answer to any of these questions is “No” or “I don’t know,” then you are 15 minutes away from a new level of asset protection in your real estate investing business and your personal life.
