(c) The juvenile courts shall help with the study by giving the commissioner existing juvenile court records relating to delinquency proceedings held on individuals described in section 245C.03, subdivision 1, paragraph (a), when requested pursuant to this subdivision. (d) For purposes of this chapter, a finding that a delinquency petition is proven in juvenile court shall be considered a conviction in state district court. (e) Juvenile courts shall provide orders of involuntary and voluntary termination of parental rights under section 260C.301 to the commissioner upon request for purposes of conducting a background study under this chapter. 245C.09 FAILURE OR REFUSAL TO COOPERATE WITH BACKGROUND STUDY. Subdivision 1. Disqualification; licensing action. An applicant’s, license holder’s, or other entity’s failure or refusal to cooperate with the commissioner, including failure to provide additional information required under section 245C.05, is reasonable cause to disqualify a subject, deny a license application, or immediately suspend or revoke a license or registration. Subd. 2. Employment action. An individual’s failure or refusal to cooperate with the background study is just cause for denying or terminating employment of the individual if the individual’s failure or refusal to cooperate could cause the applicant’s application to be denied or the license holder’s license to be immediately suspended or revoked. 245C.10 BACKGROUND STUDY; FEES. Subdivision 1. [Repealed, 2009 c 142 art 2 s 49] Subd. 1a. Expenses. Section 181.645 does not apply to background studies completed under this chapter. Subd. 2. Supplemental nursing services agencies . The commissioner shall recover the cost of the background studies initiated by supplemental nursing services agencies registered under section 144A.71, subdivision 1, through a fee of no more than $20 per study charged to the agency. The fees collected under this subdivision are appropriated to the commissioner for the purpose of conducting background studies. Subd. 3. Personal care provider organizations. The commissioner shall recover the cost of background studies initiated by a personal care provider organization under sections 256B.0651 to 256B.0654 and 256B.0659 through a fee of no more than $20 per study charged to the organization responsible for submitting the background study form. The fees collected under this subdivision are appropriated to the commissioner for the purpose of conducting background studies. Subd. 4. Temporary personnel agencies, educational programs, and professional services agencies. The commissioner shall recover the cost of the background studies initiated by temporary personnel agencies, educational programs, and professional services agencies that initiate background studies under section 245C.03, subdivision 4, through a fee of no more than $20 per study charged to the agency.
