Enbridge Gas Distribution Inc. (“Enbridge”) and Union Gas Limited (“Union Gas” or combined “the companies”) have each filed an application with the Ontario Energy Board (the “Board”), dated September 30, 2011 seeking an order or orders approving or fixing rates for the sale of natural gas by Enbridge and Union Gas that include the cost consequences of the purchase of biomethane. The applications have been filed under section 36 of the Ontario Energy Board Act, 1998. Biomethane is processed from biogas and landfill gas. Biogas and landfill gas result from the decomposition of organic material in an oxygen-free environment, either as a result of a controlled process within an anaerobic digester or as a result of a natural process in a landfill site. The Board has assigned file number EB-2011-0242 to the Enbridge application and file number EB-2011-0283 to the Union Gas application. Both Enbridge and Union Gas propose to acquire biomethane as part of their respective supply portfolios for customers who purchase natural gas from the companies. The companies propose to limit the volume of biomethane and the length of time over which it will be purchased. The companies have requested approval of a pricing framework approving the purchase of biomethane from Ontario producers at specified prices and for a 20-year term. If accepted, the companies’ proposal would result in an increase of approximately $1.50 per month to the average residential customer’s bill, based on current natural gas rates. How to see Enbridge Gas Distribution Inc.’s and Union Gas Limited’s Applications Copies of the applications are available for inspection at the Board’s office in Toronto and on its website, www.ontarioenergyboard.ca/OEB/Industry, and at both Enbridge’s and Union Gas’ offices and on their websites. Hearing Pursuant to its powers under section 21(5) of the Ontario Energy Board Act, 1998, the Board will combine these hearings. The Board has determined that it will hold an oral hearing for these applications. How to Participate You may participate in this proceeding in one of three ways: 1. Become an Intervenor Intervenors participate actively in the proceeding (i.e., submit written questions, evidence, and arguments, and cross-examine witnesses at an oral hearing). A request for intervenor status must be made by letter of intervention and be received by the Board no later than 10 days from the publication or service date of this notice. A letter of intervention must include: (a) a description of how you are, or may be, affected by the outcome of this proceeding; (b) if you represent a group, a description of the group and its membership; and (c) whether you intend to seek an award of costs and the grounds for your cost award eligibility. You must provide a copy of your letter of intervention to the applicant. Everything an intervenor files with the Board, including the intervenor’s name and contact information, will be placed on the public record, which means that all filings will be available for viewing at the Board’s offices and will be placed on the Board’s website. If you already have a user ID, please submit your intervention request through the Board’s web portal at www.errr.ontarioenergyboard.ca. Additionally, two paper copies must be submitted to the address set out below.
