GENERAL INFORMATION

TRANSPORTATION: Transportation for horses will be available to any place in the United States. Commercial haulers will be present. (See Special Notices for information regarding required Brand Inspections ). INSURANCE: Representatives from major equine insurance companies will be present. ABSENTEE BUYERS: Arrangements can be made through our sales office for absentee phone bidding. If you plan to bid by phone you must register prior to bidding and be pre-approved no later than noon August 15. A “Request to Purchase by Check” and/or a bank “Letter of Credit” must be on file prior to conducting absentee bidding.

VETERINARIANS: The Sale Veterinarian will be available during the day for inspection of animals.

STALLS: Stall assignments will be available about two weeks prior to the sale.

REGISTRATION PAPERS: After all accounts are settled, the ownership will be transferred to the new owner by the Sale Company. AQHA will then send the QH Certificate to the new owner. All registration papers not to be transferred will be returned to the proper owners within 30 days of the sale. No papers will be distributed at the sale.

SEATING: There is no “reserve” seating. Plenty of seating is available inside the Pavilion and outside in the display ring area. For those with special needs, please go the Sales Office.

SPECIAL NOTICES (1) Read Carefully

CARE OF HORSES AFTER SALE: Although it is the consignor’s responsibility to provide care and feed for their horses until noon the day following purchase, please be reminded that title passes at the fall of the hammer, at which time the purchaser assumes all risk and responsibility for the horse. Purchasers are advised to contact the consignor confirming when the horse will be picked up and insuring that proper care will be provided until that time. The horse Sale Company is not responsible for care and feeding. ALL HORSES MUST BE REMOVED FROM THE SALE PREMISES BY NOON OF THE DAY FOLLOWING THE LAST SALE SESSION . Any delays in shipment must be approved by the Sales Company and these animals are left at the buyer’s risk and are the buyer’s responsibility for care and feeding. A $50.00 per day charge will be assessed for any animal left without care and feed. ALL ACCOUNTS MUST BE PAID AT TIME OF SALE, unless satisfactory credit has been established deferring payment to within ten days of sale. Payments received later than ten days from date of sale are subject to 1.5% interest per month on unpaid balance. Checks returned “insufficient funds” are subject to a $125 charge, plus attorney fees and court costs.

BUYERS must have presented a REQUEST TO PURCHASE BY CHECK form ten (10) working days prior to the sale.

AGENT’S AUTHORIZATION : Persons acting as agents must so indicate on the Acknowledgment of Purchase (AOP) and have filed an ’ Agent s Authorization form with the Sale Company.

EXAMINE HORSES PRIOR TO PURCHASE: Examine horses before bidding! Veterinarians are available on-site at bidder’s expense.

THERE IS NO IMPLIED WARRANTY made by the Sales Company nor consignor as to the merchantability or fitness for a particular purpose of any horse offered for sale in this auction.

IT IS THE RESPONSIBILITY OF THE CONSIGNOR to : 1. Ensure that the correct animal has been hip numbered. The Sale Company assumes no responsibility that the animal auctioned is the same as pre- sented in the catalog. 2. Ensure that the Certificate of Registration accurately describes the ani- mal being sold. If AARHS inspectors discover that discrepancies exist, a Corrected Certificate form, four photographs, and a $20 fee must be submitted to AQHA. The Sale company charges $75 for this service. SPECIAL NOTICES (2) RESERVE BIDS & UPDATES : Reserve BIDS and UPDATES will be accepted no later than 12:00 noon on the day of the Sale. Forms are available on www.raceruidoso.com/horse-sales , in the catalog, and in the Sales Office. ANNOUNCEMENTS: Pay attention to all announcements made during the sale. Supplemental information occurring after the catalog was printed is provided to buyers in the form of announcements by the auctioneers during the auction. This information can be extremely important regarding changes in the catalog description of the horse and could be vital in determining the suitability and desirability of bidding on the entry. Prospective buyers can question the consignor as to any updates pending as announcements prior to the auction. PAY ATTENTION TO THESE ANNOUNCEMENTS . STAKES ENGAGEMENTS: All eligibility payments due following the auction become the responsibility of the buyer. Each track has a Nomination Secretary (Doris Alvarez or Monique Figueroa 575-378-7224) who is responsible for receiving the proper payments. It is the buyer’s responsibility to notify the Nominations Secretary of their purchases and mailing address in order to receive future payment schedules. The Sales Company validates Triple Crown eligibility; reliability of all other engagements as shown in the catalog per the Consignor are assumed to be correct but not guaranteed by the Sale Company. ACKNOWLEDGMENT OF PURCHASE (AOP): This document is the purchase agreement indicating the purchaser, the purchaser’s address, the Hip number purchased and the purchase price . When the clerk presents the document for signature, it is the responsibility of the buyer or the buyer’s agent to provide the correct information to transfer ownership. This legal document assigns payment responsibility. Whomever signs the AOP is ultimately responsible for payment whether it be the new owner or an agent. Every AOP requires proper execution of information and signature of bidder, whether it be an actual purchase or a repurchase. Cooperation with the ticket clerk is appreciated in all instances. Present the gold buyer copy when paying. HEALTH CERTIFICATE & COGGINS: A current, licensed veterinarian’s health certificate , including EHV-1 vaccination specifications, and a negative Coggins test are required for each yearling. Coggins must have been performed within six (6) months of sale date. Copies will be provided in each buyer’s package. Each Consignor is aware that these requirements are mandatory for inclusion in auction; a copy of both can be found in the Buyer’s Package available upon payment of purchase. TRAVEL REQUIREMENTS: The New Mexico Livestock Board requires travel permits for all animals coming in from out-of-state. Please contact the NMLB permit line for an entry permit (800-432-6889). MULTIPLE EMBRYOS: Neither the Sale Company nor the Sale Catalog Company will be held responsible for providing information as to multiple embryos (foals of the same year) out of mares or dams in the Sale; nor will they be held liable in any way for buyer’s belated awareness of such information. This information is provided by the consignor and is assumed to be accurate.

RADIOGRAPH REPOSITORY

CONSIGNORS may contact Rexann Morrison for applications and submission details at 737-299-2045 or email thexraylady@gmail.com . Asteris will provide veterinarians with an online application for remote data submission. Consignors will receive a link for accessing statistics such as how many times a consignment has been viewed and for how long. Asteris charges a $20 submission fee per horse. This fee will be withheld from the Consignor’s account. Radiographs are not mandatory. Asteris and the Sale Co. will require two items for submission of radiographs to the repository: 1. All radiographs must be acquired between July 30, 2025 and August 27, 2025. They will not be accepted after 5 pm MST on August 27, 2025. 2. The veterinarian must verify the AQHA registration papers and the hip number as it appears in the Sale catalog for each consignment. Only licensed veterinarians may view the radiographs with a buyer. There is no charge for viewing. The radiographs are the property of the consignor. The on-site Repository will be open for viewing in the metal barn just north of Barn #1 on Thursday, August 28, 2025, from 7:30am to 5:00pm and Friday/Saturday from 9:00am until the last sale of the day. Radiographs can be viewed in the ONLINE repository any date between July 30, 2025 and August 30, 2025. If any additional views are requested, the seller has first right of pay for the view and have that view included in the yearling’s file. If the seller does not wish to pay for the additional view, then the new view is the property of the prospective buyer. Radiographs are no longer available for viewing after the horse sells. Any “buy back” horse’s radiographs can be viewed in the repository, if the consignor gives permission to “pass them in” to the repository. These “pass in” x-rays are no lon- ger available after the end of the sale. AARHS will not review the Repository information and makes no warranty or assurance of any kind concerning the authenticity, sufficiency, quality, completeness or accuracy of Repository information, all of which shall be the responsibility of the Consignor. Knowledge of the Repository information therefore shall not be imputed to All American Ruidoso Horse Sale Company, LLC. See Thirteenth Condition of Sale - Arbitration for specific provisions as applies to the Repository. In the event of a conflict, a panel of veterinarians will be convened to determine appropriate action. AARHS shall have no liability, shall give no opinions, and shall be held harmless from any loss incurred by either party. If the panel decision is not unanimous, majority shall rule. The panel’s decision is final.

The Right of Rejection shall terminate immediately upon re- moval of the horse from the sale grounds.

RADIOGRAPH REPOSITORY, Continued

Consignors will be held responsible for associating radiographs with the proper horse. If the horse name is changed on the radiographs knowingly or unknowingly, or if the images have been tampered with, the consignor is responsible for any charges incurred from a dispute. If a discrepancy is found after a buyer purchases a horse, they have twenty-four (24) hours to report it to Asteris and the Sale Co. During that time, the horse may not be moved from the premises for any reason other than a medical emergency. In an attempt to prevent “buyer’s remorse” the buyer must pay Asteris and/or the sales company an $800.00 deposit to investigate a disputed purchase. Asteris will send the radiographs to three equine veterinarians of their choice for review; the veterinarians will not be diagnosing, but only verifying that the radiographs in comparison are from different horses. If the veterinarians determine that the original radiographs are from the horse in question, the buyer must pay all fees associated with the challenge pro- cess. If it is found to be a different horse, the consignor will be held responsible for all charges including the $800.00 deposit and the commission fee to the sales company from the resulting lost sale. VETERINARIANS: Only Digital DICOM images will be accepted and only the 32 images as follows: BOTH FRONT FETLOCKS: DP, DLPMO, DMPLO, flexed lateral medial...................8 shots. BOTH CARPI: DLPMO, PLDMO (just off lateral), flexed lateral medial..............................6 shots. BOTHHINDFETLOCKS: DP, DLPMO, DMPLO, standing lateral medial................8 shots. BOTH HOCKS: just off DP 10 degrees (slight DLPMO), lateral medial, PLDMO.......6 shots. BOTH STIFLES: Lateral medial (getting the proximal tibia as well as the trochlear ridges of the femur and patella) and a plantar anterior as long as the condyles are visible.....4 shots. Please label the studies in this manner: Patient = Hip # as shown in the sale catalog (Horse name not required) Owner = Consignor as listed in the sale catalog. Accession # = Day the horse sells and hip #, i.e. Day 1 - #01

Neither Asteris nor the Sale Co will be screening images for positioning or tech- nique; this is the responsibility of the veterinarian at the time of acquisition.

CONDITIONS OF SALE: BIDDERS TAKE NOTICE All American Ruidoso Horse Sales, LLC, Ruidoso Downs, New Mexico THIS SALE IS CONDUCTED IN ACCORDANCE WITH, AND ALL ACTS OF IN- TERESTED PARTIES AND/OR CLAIMS BY THEM SHALL BE GOVERNED BY, THE FOLLOWING CONDITIONS OF SALE: FIRST-APPLICABLE LAW : All horses in this sale are offered according to the laws of the state wherein the sale is conducted. The right to bid, as provided un- der law, is reserved for all consignors unless otherwise announced. SECOND-THERE IS NO WARRANTY EXPRESSED OR IMPLIED BY THE AUC- TIONEER, SPONSORS, OWNER OR CONSIGNOR, AS TO THE PER- FORMING SOUNDNESS, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY HORSE OFFERED IN THIS SALE. ALL HORSES ARE SOLD “AS IS” WITH ALL EXISTING CONDITIONS AND DE- FECTS EXCEPT AS SET FORTH IN CONDITIONS EIGHTH, NINTH, TENTH, AND ELEVENTH BELOW. ALL PURCHASERS SHALL FULLY INSPECT EACH HORSE THAT THEY MAY PURCHASE. Purchasers will be charged with knowl- edge of any defect that is or should be revealed by a reasonable inspection, includ- ing any defect that is or should be revealed by a review of the Repository information, with the exception of the Consignors’ Item #1 of the Tenth-Limited Warranties. Announcements made by the auctioneer in conjunction with the sale of the horse in question supersede all other information. Any defect which will, more likely than not, materially and adversely affect the horse’s suitability for train- ing and racing, that appears on radiographs taken within 24 hours after the session in which the horse is sold and taken before the horse leaves the AARHS grounds, which does not appear on the Radiographs filed with the Repository prior to the sale, is subject to dispute resolution as provided in the Thirteenth Condition of Sale – Arbitration which may result in a return of the horse to the Consignor and a re- fund of the purchase price. The presence or use of the Repository shall not change any of these Conditions of Sale, which shall continue to be binding upon all parties nor does it create any additional express or implied warranties. In the event Consignor elects to place information in the Repository for any sale con- ducted by AARHS, Consignor warrants that Consignor has deposited in the Re - pository all of the required views mandated by AARHS and further warrants the authenticity and validity of said views. Consignor further warrants the accuracy, va- lidity and authenticity of all other information placed by Consignor in the Repository. In the event it should be determined that Consignor has placed information in the Repository which is not accurate, valid or authentic in all material respects and such information is deemed to be materially misleading regarding the condition of the horse or its suitability for training and racing, then the sale is subject to Rejection at the option of the Purchaser, and Consignor, in that event, shall (i) refund the pur- chase price to the Purchaser together with any proper and reasonable expenses incurred by Purchaser including interest at the rate of 12% per annum, and (ii) pay AARHS entry fees and commission as if the sale had been final. All items, including Radiographs, placed by Consignor in the Repository are the sole property of the Consignor(or the Consignor’s veterinarian) and Consignor shall have the right to receive all such items and information back 48 hours after the end of the session in which the horse in question was sold. However, AARHS may elect to hold such items on behalf of the Consignor in the event a dispute arises concerning these Conditions of Sale and will return the items to Consignor upon the resolution of the dispute. Further, AARHS may permit the Purchaser to receive such items only if Consignor has agreed to permit the Purchaser to receive such items or information. In the event Consignor fails to pick up the items and informa- tion contained in the Repository within 30 days after the end of the Sale, AARHS may elect to notify the Consignor (and/or the Consignor’s veterinarian, if known) of the AARHS intent to destroy or otherwise dispose of said Repository information 10 days after notice from the AARHS of its intent to take such action and AARHS shall be held harmless by Consignor for any losses or expenses incurred as a result of AARHS disposition of the items contained in the Repository. 7

Purchaser may elect Rejection only upon complying with the following: (1) Written statement from Purchaser requesting Rejection must be received by All American Ruidoso Horse Sales, LLC within twenty-four (24) hours after the ses- sion in which the horse is sold and Be fore the horse leaves the AARHS grounds; (2) Radiographs of the subject horse must be taken within twenty-four (24) hours af- ter the session in which the horse is sold and be fore the horse leaves the AARHS grounds; (3) copies of the Radiographs together with Purchaser’s veterinary certificate (“Neg- ative Certificate”) containing the opinion of Purchaser’s veterinarian describing in detail the specific defect on which the claim is based and that defect, in the opinion of the certifying veterinarian will, more likely than not, materially and adversely af- fect the horse’s suitability for training and racing. In the event radiographs placed in the Repository do not reasonably reveal the defect described in the Negative Certificate, Consignor shall either accept Rejection or de- liver to AARHS a Consignor’s veterinary certificate contrary to that of the Purchaser (“Positive Certificate”). The Positive Certificate must be received by AARHS within twenty-four (24) hours of Consignor’s receipt of the Negative Certificate. In the event of a receipt by AARHS of a Negative and Positive Certificate, AARHS will pro- vide Consignor and Purchaser with a list of a minimum of five (5) veterinarians and a panel of three (3) veterinarians shall be convened in the same manner as provided for in Condition Thirteen-Arbitration . The Consignor and Purchaser acknowledge that the selection process is fair and reasonable to each of them. A panel of three (3) veterinari- ans shall be elected. AARHS shall provide Consignor and Purchaser (or their represen- tatives) with a list of not less than five (5) veterinarians. Consignor shall have the first strike of the veterinarian deemed most unacceptable to him, and Purchaser shall have the second strike, and they shall alternate thereafter until three (3) veterinarians remain on the list. AARHS shall then determine if all three veterinarians can serve on the panel and if not, AARHS canvas the other veterinarians struck in reverse order until three are found who will serve. If three are not found, the parties shall repeat the process under such conditions as AARHS shall determine until three veterinarians are found who will serve. The Consignor and Purchaser acknowledge that the selection process set out herein is fair and reasonable to each of them. The panel shall determine, based upon such examination(s) that each panel mem- ber determines appropriate to support their decisions, whether the horse has an in- jury to or disease of the bone structure which will, more likely than not, materially and adversely affect its suitability for training and racing, which was not reasonable revealed on the Repository radiographs, and in that event the sale shall be cancel- ed. Otherwise, the sale shall stand. The decision of the panel shall be final, binding and conclusive on all parties, absent fraud or bath faith. If the panel is not unani- mous, a majority vote shall be determinative. The limited right of Rejection contained in this Condition shall terminate regardless of whether twenty-four (24) hours have elapsed, immediately upon the removal of the horse from AARHS grounds. Consignor shall have the sole responsibility concerning the accuracy of the disclo- sures/announcements and both Consignor and Purchaser agree that AARHS is absolved from any liability relating to such announcements/disclosures and both agree to hold the AARHS harmless from any loss incurred by either of them relating to such announcement/disclosure. If Rejection is requested by Purchaser on the basis of non-compliance with items (1), (2), or (3) of this Condition Thirteen-Arbitration , Purchaser must give written notice to AARHS within fourteen (14) days of the sale of the horse and AARHS shall conduct such investigation as it deems appropriate and determine whether either items (1), (2), or 3) is applicable, and if so, the sale shall be canceled, the horse returned and payment refunded. AARHS decision shall be determinative and binding upon Consignor and Purchaser.

THI RD-BID D IN G P RO C E DUR E : Unless waived by announcement, there shall be an upset price of $1,500 on any animal entering the sales ring. If an opening bid in the amount of the upset price is not immediately forthcoming to the auction eer’s call, the animal shall be passed out as unsold. The person making the highest bid recognized by auctioneer shall be the buyer. The auctioneer shall immediately present the buyer with a document entitled Acknowledgment Of Purchase . Should such presentation not be made prior to commencement of bidding on the next lot offered, the buyer shall forthwith identify himself or herself to auctioneer as the buyer and sign the Acknowledgment Of Purchase . In the event that a person other than the recognized buyer signs the Acknowledgment Of Purchase , such ac- tion shall not give such other person any right or title to the horse. Immediately after such erroneous signing of the Acknowledgment Of Purchase becomes known to the auctioneer, he shall cause the Acknowledgment Of Purchase to be presented to the recognized buyer for signature. If the highest bidder fails to immediately execute the Acknowledgment Of Purchase or otherwise fails to comply with the Conditions of Sale, or in the event of a mistake by the auctioneer, AARHS Reserves the option to re-sell the animal and such resale shall terminate all obligations of AARHS and the consignor to honor any prior bid. FOURTH-BIDDING DISPUTES : Should any dispute arise between or among two or more bidders, the auctioneer shall forthwith adjudicate the dispute, and his decision shall be absolute, final and binding on all parties. Bids received by personnel em- ployed by the undersigned have the same stature as bids received by auctioneer. In case of dispute, the bidding shall be reopened for advanced bids, and if there be no advanced bid, the horse is sold to the person from whom auctioneer recognized the last bid. Advanced bidding shall be restricted to the disputing parties, unless the bid be reduced below the level of the recognized bid at commencement of dispute, in which case bidding is reopened to all. The auctioneer reserves the right to reject any or all bids. FIFTH-TITLE AND DELIVERY: Title passes to buyer at fall of the hammer. All risk of injury to the horse becomes buyer’s risk at passing of title. Horse will be held for buyer by consignor until buyer makes settlement as provided in CONDITION SIXTH below. Buyer shall immediately present himself or herself to make settle- ment if requested by auctioneer, but in any case shall so present himself or herself within thirty minutes of conclusion of the sales session in which the horse was pur- chased. Upon settlement by buyer, horse will be delivered pursuant to a “stable re- lease” provided by undersigned to buyer or his or her representative. Buyer or his or her representative shall present “stable release” to designee of undersigned to re- move horse from sales premises after taking possession, but in any case taking pos- session of the horse by buyer or his or her representative shall constitute delivery. Upon delivery, buyer shall cause horse to be removed promptly from the sales pre- mises, or shall be subject to stable charges as determined by undersigned. In addi- tion, should purchaser fail to cause horse to be removed promptly, undersigned may cause horse to be removed from sales premises at buyer’s risk and expense. SIXTH-TERMS FOR SETTLEMENT: Buyer shall make settlement with cashier of the undersigned. Payments to others, including consignors or their represen- tatives, do not constitute settlement. Buyer shall present himself or herself to make settlement as provided in CONDITION FIFTH above for the full purchase price, such settlement to be in form of U.S. currency or equivalent acceptable to cashier. The Acknowledgment of Purchase is not transferable without the ap- proval of AARHS and the copy of the Acknowledgment of Purchase retained by the buyer must be presented by the buyer at the time of settlement. SEVENTH-DEFAULTERS: SHOULD BUYER FAIL TO COMPLY IN ANY RESPECT WITH CONDITIONS FIFTH AND SIXTH ABOVE, THE UNDERSIGNED MAY, IN ITS ABSOLUTE DISCRETION, PURSUE ANY REMEDY AVAILABLE AGAINST THE DEFAULTING BUYER, INCLUDING, BUT NOT LIMITED TO, TAKING POS- SESSION OF THE HORSE, RESALE OF THE HORSE AT PUBLIC AUCTION OR BY PRIVATE TREATY FOR ACCOUNT OF DEFAULTER. In any such case de- faulter shall be liable for any deficit in his account after charging to his account all costs of maintenance and resale, including, but not limited to, service charges, attorneys fees, costs of litigation, and damages available to undersigned by law.

EIGHTH-WARRANTIES AS TO DESCRIPTION: UNLESS OTHERWISE AN- NOUNCED THERE IS NO REPRESENTATION OR WARRANTY AS TO THE BREEDING QUALITIES OF ANY HORSE DESCRIBED AT TIME OF SALE. NINTH-WARRANTIES AS TO SOUNDNESS: UNLESS EXPRESSLY ANNOUNCED FROM THE AUCTION STAND, OR BY OFFICIAL PUBLICATION OF THE UNDERSIGNED, OR AS HEREINAFTER PROVIDED, THERE IS NO WARRANTY OR GUARANTEE OF ANY KIND AS TO THE SOUNDNESS OR CONDITION OR OTHER QUALITY OF ANY HORSE SOLD IN THIS SALE. TENTH-LIMITED WARRANTIES. 1. Horses which are unsound in wind (applicable only to racing prospects which have started) or eyes, are “cribbers”, “wind suckers”, “bleeders”, or “crypt or- chids/monorchids” must be so announced. Horses currently on any starters’ lists, or which have been administered Lasix in their last three (3) starts must be so announced. 2. Veterinary services are available to bidders in the stables and each bidder is en- couraged to conduct such inspection and examination of each animal as the bid- der desires prior to bidding. Except as otherwise announced by the auctioneer at the time of sale, the consignor of each animal represents and warrants to the buyer and AARHS title to the animal free from all adverse claims to ownership, use or possession. Except for the foregoing limited warranty each animal is sold by the consignor WITHOUT WARRANTY AND WITH ALL FAULTS. In the event that any animal is not as represented in the Sale Catalog or on the breach of the foregoing limited warranty (as the Sale Catalog or limited warranty might be modified by announcement at the time of sale) the buyer shall file with AARHS a written notice of rejection of the animal with such supporting certificates as AARHS might require within twenty-four (24) hours after the close of the Sale session in which the animal was purchased. If the buyer rightfully rejects the animal in the manner and within the time provided, the animal will be returned by the buyer to the consignor and the consignor will refund to the buyer the full purchase price of the animal together with all reasonable expenses incurred by the buyer in connection with the animal from the time of sale until the return to the consignor. 3. Neither AARHS nor QDATA/ RGP nor AQHA will be held responsible for provid- ing information as to multiple embryos (foals born in the same year) or to embryo transfers out of mares or first dams in sale; nor will any of listed companies be held liable in any way for buyer’s belated awareness of such information. ELEVENTH-CONSIGNEE STATUS: AARHS is operating as an independent contractor engaged in the business of conducting a consignment sale. AARHS has compiled the Sale Catalog from information provided by the designated con- signor. All announcements by the auctioneer at the time of sale are made on be- half of the designated consignor and will take precedence over the printed provisions of the Sale Catalog. In the event of any dispute between the buyer and the consignor, AARHS will occupy the position of agent for a disclosed prin- cipal and stake holder and will be discharged from all obligations owing to the consignor or the buyer on delivery of any property or funds held by AARHS to the Court having jurisdiction of such dispute. AARHS makes NO REPRESENTA- TION OR WARRANTY with respect to any animal and the buyer must look solely to the designated consignor for recovery of any damage by reason of the failure of any representation or limited warranty. TWELFTH-CATALOG AND ANNOUNCEMENTS: Horses catalogued in this sale are offered as represented by consignor, and auctioneer is not responsible for the accuracy of information provided. While certain information may have been pro- cured by auctioneer from third parties on behalf of consignor, it is nonetheless solely the responsibility of consignor to verify the accuracy of such information and to no- tify the auctioneer of any corrections prior to sale. With respect to produce records of broodmares, the terms “barren” or “open” shall mean that the mare was bred, was not found to have slipped, and failed to produce a foal. In case of error or omis- sion, buyer shall seek redress only from consignor.

THIRTEENTH-ARBITRATION : 1. Any controversy arising out of a claim arising under WARRANTIES shall be settled by arbitration between the buyer and con- signor pursuant to the following procedure: Upon the auctioneer’s determina- tion that a claim under such CONDITIONS OF SALE has been timely and properly presented by the buyer pursuant to these CONDITIONS OF SALE, and upon notice from the auctioneer, the buyer and the consignor shall each se- lect a licensed veterinarian acceptable to the auctioneer. If such veterinarians fail to agree promptly as to the validity of the claim, they or the buyer and the consignor involved in the controversy, shall agree upon a third licensed veteri- narian. If such two veterinarians, or the buyer and the consignor, are unable to agree promptly upon the third veterinarian, the auctioneer shall appoint the third veterinarian. The third veterinarian’s fee, expenses and costs shall be paid by the party whose property the horse is determined to be. The panel of three vet- erinarians shall conduct any tests, investigation, or examinations which they deem necessary, and may, in their discretion, conduct a hearing by notifying the auctioneer to arrange for the hearing, and shall, by majority vote, determine the validity of the claim. The auctioneer shall determine the amount of reimburse- ment due to a buyer whose claim is found to be valid and may, in its sole discre- tion, conduct a hearing to aid in making such a determination, and such determination shall be incorporated in the award. 2. Any other controversy between or among the buyer, consignor & auctioneer arising out of a claim made under these CONDITIONS shall be settled by arbi- tration among the parties in accordance with the American Arbitration Assoc. 3. Arbitration under 1 or 2 above shall take place in a location to be designated by the Sale manager. Judgement upon any award rendered by the arbitrator(s) may be entered by any party and any court having jurisdiction thereof. The auc- tioneer will be entitled to reimbursement from the party whose property the horse is determined to be for reasonable attorney’s fees and other costs in- curred in the arbitration and any related court proceedings. FOURTEENTH-COLLATERAL AGREEMENTS: The auctioneer shall not be bound by any oral or written agreement or alleged agreement varying from these CONDITIONS OF SALE between the buyer and the consignor unless agreed to by the auctioneer, and any controversy or claim between the buyer and the consignor arising under any such agreement shall be a matter for their resolution.

ADDITIONAL LIMITED WARRANTY

CONSIGNORS warrant that any yearling in the All Ameri- can Ruidoso Horse Sale, LLC (AARHS) shall not have been administered any Exogenous Anabolic Steroids, Clenbuterol, Albuterol, Bisphosphonates, Ractopamine, Zilpaterol, Carmoterol (or any bronchodilator), or Beta Agonists (prohibited substances). For the purchaser to avail him or herself of this Warranty, the purchaser agrees to pay AARHS $500 to cover direct costs and administrative expenses regarding the blood or hair sample being taken. AARHS will then arrange for the Sale veterinarian or Sale representative to obtain a blood or hair sample to be taken immediately after the fall of the hammer and prior to the animal leaving the sale grounds, to be sent to a laboratory selected by AARHS for testing for prohibited substances (PS). Should the post-sale test reveal the pres- ence of a PS at such level as determined by the testing labo- ratory that shows that a PS is present in the system of the horse (positive test), the purchaser shall have the right to re- scind the purchase of the horse, in which case the pur- chaser must give notice to AARHS within 24 hours of notification of the positive test results. If the purchaser chooses to rescind the purchase of the horse as a result of the positive test for PS, AARHS will refund the purchase price which has been held from the Consignor pending the test results. AARHS will give the test results to the pur- chaser and seller as soon as practical after receiving the re- sults, usually within ten days of the Sale date. In addition, neither the purchaser or consignor shall have the right, nor shall AARHS have any obligation to conduct test- ing of a split sample. AARHS’s decision concerning the va- lidity of a positive test, supported by the testing laboratory selected by AARHS, shall be fully binding upon the con- signor, purchaser, and all other interested parties. In the event any party challenges the AARHS’s exercise of discre- tion, absence of fraud, or bad faith, such party shall be liable for all AARHS reasonable expenses including, but not lim- ited to such items as the $500 testing fee, veterinarian charges, vanning, insurance, and boarding. Purchaser will be required to exercise due care during the recession pe- riod in maintaining and boarding of the horse. The pur- chaser shall not cause the horse to be materially altered during the recession period.

In the event of a positive test, risk of loss shall remain with the purchaser from the fall of the hammer until the consignor has been notified of purchaser’s election to rescind the sale at which time risk of loss passes back to the consignor. The consignor shall remain responsible for paying the standard commission and fees, based upon the gavel price, as indi- cated on the Consignor’s Contract and for the testing fee, veterinarian charges, vanning, insurance, boarding, and any other expenses incurred while the purchaser waited for the test results. In reference to Exogenous Anabolic Steroids, upon the recom- mendation of the Scientific Advisory Committee of RCI, AARHS will use the 25pg/ml plasma level for quantification as a basis for a positive test, which means an effective ban on us- ing any of the four anabolic steroids, Testosterone, Stanozolol, Boldenone, and Nandrolene. Recommended withdrawal times are as follows: Testosterone = 28 days; Stanozolol = 49 days; Boldenone = 130-140 days; Nandrolone = 49 days. Pay special attention to the type of medication used when determining the withdrawal time. In the event that generic anabolic steroids are being used, the with- drawal times may vary. Testing for Clenbuterol, Albuterol, or Beta Agonists will be via the hair follicle testing procedure. Furthermore, zero tolerance for Clenbuterol, Albuterol, Carmoterol (or any bronchodilator), or Beta Agonists will be the basis for a positive test for these prohibited substances. The sale of a Thoroughbred or Quarter Horse shall be con- sidered an unfair or deceptive act or practice if the Seller (1) knows or has reason to know that the horse has been ad- ministered a substance that the authority determines has a long-term degrading effect on the soundness of the horse, and (2) fails to disclose to the buyer the administration of such substances. ALL AMERICAN RUIDOSO HORSE SALES, LLC MAY CONDUCT RANDOM TESTING AT THEIR DISCRETION! EXCEPT FOR THE LIMITED WARRANTIES, EACH ANI- MAL IS SOLD “AS-IS” WITH ALL DEFECTS AND EX- ISTING CONDITIONS AND WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED.

MULTIPLE EMBRYOS

Since the American Quarter Horse Association (AQHA) rule change allowing multiple foals to be registered out of the same mare in the same year, it is not possible for the AQHA, Equineline, the Sale Company nor the Sale Catalog Com- pany to know how many live foals a mare has produced in a given year. PLEASE NOTE: Because a foal is an embryo transfer born to a recipient mare, it does not nec- essarily mean that it is one of multiple embryos . The fact that a foal was not an embryo transfer does not necessarily mean that it was a single foal . Neither the Sale Company nor the Sale Catalog Company will be held responsible for providing information as to multiple embryos (foals of the same year) and/or embryo transfers out of mares or dams in sale; nor will either be held lia- ble in any way for buyer’s belated awareness of such information.

ACCEPTABLE METHODS OF PAYMENT

THE FOLLOWING RULES APPLY:

1. In order to be pre-approved to pay by personal or business check, a completed, notarized BUYER REGISTRATION & REQUEST TO PURCHASE BY CHECK form (available in the catalog or on website) must be received by the Sale Company no later than 10 working days prior to the sale.

2. The following applies to all purchases by check: a. No out-of-the-country checks will be accepted. b. No second-party or third-party checks will be accepted. c. All checks will be deposited the next banking day. d. Payment is required on the date of purchase.

3. For those without pre-approval to pay by check, we will accept Wire Transfers, Money Orders, Cashier’s Checks and Credit Cards.

Credit Card payments are charged an additional 3%.

The IRS treats Cashier’s Checks and Money Orders as Cash and requires the Sale Company to report all “cash” payments in excess of $10,000.

A Letter of Credit from purchaser’s bank may be substituted for the “ Buyer Registration & Request to Purchase by Check ” form.

4. There will be a $125 minimum charge, plus attorney fees and sale company expenses for checks returned “insufficient funds.”.
