from 1 November 2018. One of the key changes is the requirement for coin change machines to be located in line of sight of a venue staffed area and in a position approved by the Commission. The Liquor and Gaming Branch recently wrote to all Licensed Premises Gaming Licence holders outlining the approval process and attaching all documentation for licensees to make submissions. The Commission must receive all submissions by 1 September 2018 to enable adequate time for consideration and avoid any compliance issues after the requirement takes effect from November. If licencees require further information regarding suitable locations for coin change machines, please contact the Branch on 6166 4040 or email gaming@trasury.tas.gov.au. A more recent focus of the Commission is the effectiveness of the Tasmanian Gambling Exclusion Scheme and the implications of venues not maintaining appropriate records or where excluded persons have not been identified. The Commission considers these types of breaches serious and has determined it will take disciplinary action against venues that are found not to have performed their responsibilities in the correct manner. In practise, the licence holder will initially be advised of a reported breach and reminded of their responsibilities. If following a formal investigation it is found that a venue has not correctly undertaken its responsibilities, disciplinary action will be considered by the Commission.
It has been nearly two years since Tasmania’s liquor laws were significantly amended to, amongst other things, help ensure patrons consume liquor responsibly and minimise harm that can result from the misuse of liquor. It has been pleasing that industry overall has adopted a responsible approach to implementing and complying with the additional requirements. The anniversary of the amendments act as a timely reminder that licensees and permit holders must advertise and promote liquor in a way that supports responsible service and consumption principles. Advertising and promotion that is likely to encourage irresponsible consumption of liquor can be banned or restricted under section 68 of the Liquor Licensing Act 1990. I encourage licence holders to review the examples of what may be considered undesirable advertising or promotion, and guidance on how to reduce the risk of promotions, in the fact sheet available on the Liquor and Gaming Branch website at www.treasury.tas.gov.au/Documents/ Advertisingandpromotionofliquor.pdf. While liquor regulation has been ‘business as usual’, there have been major changes recently to the regulation of gambling informed by the Tasmanian Liquor and Gaming Commission’s review of the Responsible Gambling Mandatory Code of Practice for Tasmania. The stronger measures implemented under the Code took effect from 1 May 2018, with some transitional measures to take effect
