Pushing hard to log miles and finish jobs, many commercial drivers facing traffic citations are tempted to just pay the fine and get back to work. The Steep Cost of Distracted Driving in California Text, Talk … Ticket!

For some kinds of offenses in California, that strategy could cost you your livelihood.

Commercial truck drivers who fail to fight their first ticket for a cellphone violation are risking far steeper penalties for a second. Since a 2021 change to the California motor vehicle code, AB47, a second conviction can result in a Negligent Operator Treatment System (NOTS) point on your license and a possible 60-day commercial license disqualification. Using your cellphone for scrolling, talking, or texting while driving is off- limits, unless your phone is mounted on your dash and you only need to swipe once to activate it. Even when you are stopped at a red light or stuck in a traffic jam, phones are still off-limits. To play it safe before sending that text or taking that call, pull over, park, and engage your parking brake. A state survey a few years ago showed that more than 56% of California drivers claimed to have been hit, or nearly hit, by a driver who was talking or texting on a cellphone, and problems with distracted driving have grown since then. Insurance companies are raising premiums sharply for distracted driving, especially for second offenses. That’s why it is important to dispute all citations for cellphone violations. A first “guilty” plea may not feel too important, but it brings you dangerously close to a commercial license disqualification and the possible loss of your livelihood.
