iv) Clause 8.4 is amended by deleting the order of precedence (a) – (e) and replacing with the order of precedence referred to in Schedule 5;
Clause 12.2 is deleted and replaced as follows:
v)
“The building period commences the date the builder commences excavation on the site ”.
Clause 19.1 is deleted and replaced as follows:
vi)
The builder is entitled to a reasonable extension of the building period if the building works are delayed by the builder suspending the building works under clause 25 or for any reason including but not limited to: (a) a variation or a request for a variation by the owner ; (b) an act of God, fire, explosion, earthquake, civil commotion or force majeure; (c) adverse weather ; (d) an industrial dispute; (e) a dispute with adjoining or neighbouring residents or owners; (f) anything done or not done by the owner ; (g) delays in getting any Permits ; (h) a delay in the supply of materials or products selected by the owner or a delay in the supply of materials or products required by the builder ( at current agreed prices) for the building works ; (i) the need for a survey or other report in relation to the site ; (j) the industry shutdown being a 3 week period commencing on or about 22 December in each year; (k) a dispute with the owner in respect of the building works ;
(l) a delay in the availability of contractors/trades; or (m) a cause beyond the sole control of the builder.
viii)
Clause 20.6 is amended:
(a) by adding the words ‘plus builder’s margin ’ after the word ‘price’ in the second line; and
(b) deleting the words ‘the total of the difference and the builder’s margin applied to that difference is added to the contract price’ and inserting the words ‘the difference is added to the contract price ’.
ix) Clause 23 is amended by deleting Clauses 23.2 (c) and 23.3(c) .
