the owner’s responsibility to ensure that the owner , the owner’s agents or invitees to site comply with attachment “E” and any directions given by the builder ;

k) it is the owner’s responsibility to provide and pay for all gas, water and electricity consumed by the builder for the entire building period ;

l) the builder does not recommend flush mortar joints to bricks which are not a true symmetrical or straight edge brick due to the inconsistent finishes of the width and depth of mortar joints which may occur. If this type of brick-and- mortar combination is selected the builder will rely on Section 18F of the Home Building Act 1989; m) unless stated in the Tender no allowance has been made for any traffic report, road closure requirements, road traffic wardens, after hour deliveries, special transport or additional persons and equipment required on certain roads. This is up to the discretion of the builder, or any statutory or other authority, and cannot be determined until receipt of the Permits, or during construction as required. Additional charges, by way of a contract price adjustment , will apply should there by any additional requirements; n) should the owner choose granite or a similar non-standard product for the kitchen or vanities the lead time for the supply of these products may affect the building works until the product is measured, cut, polished and installed. The owner also acknowledges that the building period may be extended by the length of time the builder has to wait for such material to be installed. The builder does not have to serve a notice for this extension of time to the building period until after the date of handover . o) should the builder or its consultants determine, or where requested by any statutory or other authority, to provide cover (commonly called tiger tails) to any overhead power lines as a result of a work, health and safety risk then the cost to provide this plus builder’s margin will be added to the contract price by way of a contract price adjustment ; p) other than owner selected inclusions, the builder may substitute, at any time without notice and at its sole discretion, the supplier of materials, provided the material is of similar colour, texture and quality; q) if applicable the owner is responsible for obtaining their own legal advice as to whether entry into this contract entitles them to any government assistance or grant (however so described) and the owner further acknowledges and agrees that:

(i)

they have not, in entering this contract , relied on any advice or representation provided by the builder or any of its employees, agents or contractors in respect of the owner’s eligibility to receive any such assistance or grant; and
