they will not bring any claim, action, suit or proceeding against the builder or any of its employees, agents, contractors or related bodies corporate for any loss, damage, cost or expense in any way related to any government assistance or grant referred to in this subclause suffered by the owner , or anyone claiming through the owner ;

(r) in the event that there is an existing swimming pool on the site and additional works are required to enable the builder to fulfil its obligations to connect the house to the sewer junction such as altering, repair or replacement of existing services, new sewer ties, re-direction of sewer or stormwater lines due to existing impediments the cost of such works, plus builder’s margin , will be charged to the owner as a contract price adjustment ; (s) The owner will be responsible for the removal of all existing tiled or paved areas, concrete slabs, sheds, fencing, trees and any other obstruction in the way of any drainage lines that are required to be installed pursuant to this contract . The owner agrees to pay the cost, plus builder’s margin , if necessary, for any hand digging required to install the drainage lines as a result of having to work around any existing obstruction; and (t) it is the owner’s responsibility, after handover , to ensure compliance with the CSIRO guidelines for slab and footing maintenance as outlined in attachment marked “K”. (u) the builder may record inbound and outbound conversations via its telephone system for the purposes of quality monitoring, staff training and compliance purposes. The owner gives their perpetual consent for conversations to be recorded by the builder’s telephone system. All recordings will be retained by the builder for a limited period and in accordance with the builder’s privacy policy. This is an essential condition of this contract as the builder’s staff members do not have the ability to switch off the telephone system.

Clause 50. Private Building Inspector

50.1 The builder acknowledges that the owner , at the owner’s discretion and entirely at the owner’s cost, may seek to engage the services of a private building inspector to review the building works . 50.2 Should the owner engage a private building inspector, the owner will comply with the “Private Building Inspectors Policy” at Attachment “H” and provide the builder with a completed “Private Building Inspector Nomination Form” prior to commencement of the building works .

50.3 Where the owner provides the builder with a report prepared by a private building inspector, the builder will review the private building inspector’s
