Work Health & Safety
Owner Restricted Access on Site
The builder observes the Work Health and Safety Act 2011 and the Work Health and Safety Regulation 2011 and requires all visitors to site to observe the same. This means that all owners must comply with the builder’s Safety systems, policies and procedures.
Due to the nature of the building works conducted on site , the builder insists that the owner ensure that the owner , any employee, agent or invitee only enter the site when accompanied by the nominated site supervisor. Any minor must be diligently supervised by an adult person.
This restriction is placed so to create a safer workplace, free from serious risk of injury or hazard for all. The builde r is contracted by the owner to carry out the building works on site . The builder has possession of the site until such time as the building works reach practical completion and are handed over to the owner . This means that the builder is responsible for Work Health and Safety on site . The owner and each of the owner’s employees, agents or invitees must observe the builder’s policies, procedures and systems relating to Work Health & Safety. Any breaches of safety regulations by the owner or the owner’s employees, agents or invitees on site , may mean that the owner may be asked to leave the site until such time as the owner can undertake to observe the builder’s Safety Policies and Procedures. Serious lack of adherence to the builder’s safety systems by the owner, may mean that the owner is restricted from entering the site at all. Where an owner has ignored a specific direction to observe a safety system whilst on the site , then the builder reserves the right to forbid the owner entry to the site until practical completion OR at least until appropriate arrangements have been made with the site supervisor.
