open will depend on the circumstances of the case and will need to consider the result of any police investigation or trial, any investigations in respect of the safety of the child or adult, as well as the different standard of proof required in disciplinary and criminal proceedings.
These may include:
Reintegration of colleagues. Invoking the disciplinary process. Alerting other known employers of the individual concerned (advise may need to be sought from either the LADO, Police, or the NSPCC helpline. Referral to the Disclosure and Barring Service (DBS) for consideration to bar the person from working with children. The DBS address for referrals is P.O. Box 181, Darlington, DL1 9FA. Telephone: 01325 953795. Referral to professional body. Outcome The following definitions should be used when recording the outcome of allegation: Substantiated: there is sufficient evidence to prove the allegation. False: there is sufficient evidence to disprove the allegation. Malicious: there is sufficient evidence to disprove the allegation and that there has been a deliberate act to deceive. Unsubstantiated: there is insufficient evidence to either prove or disprove the allegation. Every effort should be made to reach a conclusion in all cases even if: The individual refuses to cooperate, although they should be given a full opportunity to answer the allegation and make representations. It is difficult to reach a conclusion. The member of colleagues has resigned, or the contractor withdraws their services. The person is deceased. SCL will not agree to the use of a ‘settlement agreement’ with a member of colleagues. This is where the member of colleagues subject to the allegation agrees to resign, the employer agrees not to pursue disciplinary action, and both parties agree a form of words to be used in future references. Nor can it be used to override SCL’s duty to make a referral to the DBS where they meet the criteria for consideration to bar them from working with children or learners (including, vulnerable adults).
