The general duty clause requires em- ployers to provide a workplace free from known hazards. Consensus stan- dards, industry best practices, and manufacturer’s Instructions (among other sources) all serve to help iden- tify known hazards and identify con- trol measures. OSHA has established that it’s the em- ployer’s responsibility to keep their employees safe. The tree care indus- try is most certainly subject to OSHA standards, laws, and regulations.
