The idea is to divert these individuals from the court system and into a support net- work that will help them avoid re-offending in future. This support network will provide them with the assistance they need which they might not be able to get if they went through the regular court process with the potential for conviction and incarceration in a standard jail. They also avoid the chance of having a criminal record since the chance they will re-offend is small or unlikely. The court system benefits through diver- sion of these individuals because it frees up judges, prosecutors, defence counsel, and court staff to focus on other more serious offences and offenders.

HAWKESBURY | The OPP and the provin- cial Crown attorney’s office are on board with a proposal to help keep some people out of the courts if they can. Inspector Bryan MacKillop, representing the OPP, and Ronald Lapensée, crown attor- ney for Prescott and Russell counties, signed a protocol agreement with Michael Lloyd, executive director for the Canadian Men- tal Health Association for Champlain East (CMHA). The agreement signed on April 25 represents several months of planning and discussions between the three parties. It creates a pre-charge diversion program that went into effect in May. The goal of the program is to help individuals who face charges for minor crimes but who are prov- en to have a severe or persistent mental ill- ness or a concurrent disorder due to mental illness or substance use that may explain their action at the time of the offence. “Often individuals who commit non-vio- lent minor criminal offences who are living with mental illness do not belong in the for- mal justice system,”stated Johanne Renaud, a CMHA team supervisor who worked on the protocol. “In many cases, there is a need for a more effective alternative and this pro-
