Collaboration and Knowledge Sharing
The defense community should share lessons learned about AI use. What tools work well? What pitfalls should others avoid? How have offices addressed particular challenges? Informal networks, conference presentations, published articles, and online forums can all facilitate knowledge sharing. Coordinated responses to prosecutorial AI use amplify individual efforts. When prosecutors use AI in ways that disadvantage defendants — whether through inadequate disclosure or intentional or unintentional misuse — defenders who share strategies for challenging such use strengthen the entire community’s advocacy. Defenders should also lead in advocating for environmentally responsible AI practices. By adopting and sharing sustainable practices, defenders demonstrate that environmental responsibility and effective representation can coexist. Defenders may also create market pressure for greener AI infrastructure by demanding environmental accountability from vendors, especially those providing legal-specific tools. And by publicly committing to sustainability, the defense community models commitments that the broader legal profession can emulate.
