We were excited to announce the soft opening of the Community Park last month. The park has quickly become a beloved gathering spot for residents, from the lush grassy area of the dog park to the bustling sports courts. The success of the Community Park is a testament to the collective efforts of our dedicated community members and staff. We are grateful for your feedback and participation in the planning phases, which helped shape this wonderful space. Thank you for making 2024 a year to remember, and here's to an even brighter year ahead!

A Message ... FROM THE ASSOCIATION PRESIDENT

EPCOR LITIGATION We have an update on our lawsuit against EPCOR related to community pond liners. After months of legal proceedings and many attempts to reach a settlement with EPCOR, the difficult decision was made to dismiss our lawsuit. This lawsuit arose after we noticed some damage to the clubhouse pond liners and collars. After reviewing the matter, our legal committee and outside counsel

advised the Board that there was a strong case for holding EPCOR responsible for the liner deterioration. Initial attempts to reach an agreement were unsuccessful, so a business decision was made to start legal proceedings. This ended up being a protracted undertaking, and as can happen when facing a well-funded opponent, the costs of continuing became untenable. There were also some unfavorable rulings by the Judge, and it was concluded that a Tonto “Win” or any meaningful settlement was unlikely. As part of the dismissal, EPCOR requested and was awarded a reimbursement of their legal fees in the amount of $386,015. We were able to negotiate a $50,000 discount, and on December 12, 2024, we paid EPCOR $336,015 to conclude the case. This outcome is obviously extremely disappointing to the Legal Committee, our outside counsel, the Board, and all of us as residents of Tonto. We know the ponds will need repairs at some point, however, we are unaware of any risk of catastrophic failure. We are hoping any significant repair can be avoided or delayed well into the future. During this time, we will continue to build our reserves to fund repair needs as they occur. Fortunately, in satisfying this fee award to EPCOR, no special assessment will be necessary. The TVA has more than sufficient reserve funds, a portion of which are earmarked for the community ponds, to pay these fees. Any money spent to prosecute the lawsuit is considered solely in furtherance of the pond repair and maintenance needs and accordingly, a justifiable reserve expense.

The key to staying safe is to be aware of your surroundings. If you notice something or someone suspicious, contact the Maricopa County Sheriff’s Office Tip Line at 602-876-8477. Please remember if you observe any suspicious activity within the Tonto Verde Community, call the MCSO at 602.876.1000 (non-emergency) or 911 for an emergency. Cell phone photos are always helpful. September 2024 - A non-resident's claim of “Theft from a Vehicle” on Tonto Verde Drive was filed with the MCSO. The investigation was conducted. The claimant was unclear if the item was stolen or lost. October 2024 - Five incidents of “Vagrant/Trespassing” were reported to the MCSO. These individuals were cited and/or removed from TVA property. October 2024 - The MCSO was notified of a “Patio Furniture Theft” that occurred while the homeowner was gone for the Summer. __________________________________________________________________ SUSPICIOUS ACTIVITY AT TONTO VERDE TVA residents have asked that they be informed of criminal activity or suspicious incidents that occur within our gates and within the neighboring area. Fortunately, these incidents are infrequent, but they do occur. When that happens, the information will be shared in the “Security Focus” column of the Tonto Times publication. The Security Committee of the TVA Board of Directors monitors criminal activity in the Rio Verde area through the Maricopa County Sheri ff ’s County (MCSO) and from other sources. If you would like additional information on any incidents reported, please use the HOA website and submit a “Security Comment Submission Form.” A member of the Security Committee will respond. Community Park

Community Park ... Is Now Open! Excitement buzzed in the air as neighbors gathered around, eager to try out the vibrant new facility. The sound of paddles striking the ball echoed through the park, accompanied by laughter and friendly banter. It was a joyous occasion, bringing together people of all skill levels, united by their enthusiasm for the sport. As the sun began to set, casting a warm glow over the courts, it was clear that this new

addition to the community park was bound to become a beloved hub for recreation and connection.

We appreciate your patience and cooperation as we work towards finalizing the park's amenities. The community's enthusiasm and support have been invaluable, and we are thrilled to see so many residents enjoying the new facilities. We look forward to welcoming more members who celebrate our shared passion for outdoor activities and connection. Maricopa County has granted us a Temporary Usage Permit, permitting residents to access the park exclusively via the Golf Cart Path from Desierto to Blue Sky Drive. Please keep in mind that you will be sharing this cart path with golfers near the green on Hole #2, so exercise caution and adhere to the signage directing you to the appropriate route towards Blue Sky Drive. Once we obtain the final permit, the main gates to the park will be open. To access the Pickleball Courts, enter your member number followed by the hashtag “#” key. All golf carts, bikes, and pedestrians MUST use the cart path for access to the park. PARK ACCESS

DESIGNATED DOG PARK

Playful barks and wagging tails filled the air as our furry residents explored the fenced area of the Dog Park, making new friends along the way. Pet owners exchanged stories, forming bonds over their mutual love for their canine companions. The dog park, with its shaded rest areas and the large and small doggie-designated areas, has quickly become a favorite spot for both the dogs and their humans. It offers the perfect blend of exercise and socialization.

Benches and tables are strategically placed for pet owners to relax and watch their dogs play, fostering community and camaraderie. The park is well- maintained, with lush grass areas and drinking fountains ensuring every visit is enjoyable and safe. This park area is a lively hub for dog lovers to gather with their beloved companions.

Whether you're at the park to play pickleball, enjoy a stroll, or spend quality time with your pets, the Tonto Verde Community Park is a tremendous asset to the community.

PANCAKE BREAKFAST A HUGE SUCCESS! The Rio Verde Fire District Pancake Breakfast on Dec. 7 was a huge success. Our firefighters served a record 530 attendees, and donations totaled $18,730. A heartfelt thank you to our firefighters and everyone who joined in the fun and donated to VerdeCares. As we ring in the New Year, the Verdes Habitat for Humanity crew are all smiles . . .

The owners of build #28 got a big surprise for Christmas when they learned they were the winners of the Kurt Warner Habitat for Humanity gift (below). The Warners fully furnished a Habitat home for a single mother, and this year’s winner was thrilled.

The Verdes Habitat for Humanity project has raised $65,514 since July 1st. Our goal is $130,000, so we’re halfway there! Donations sent by April 14 can be used as tax deductions for 2024 or 2025. There are postcard-size informative pamphlets to pick up at the Rio Verde Post Office and at the Tonto Verde Clubhouse near the entry and library. Checks to Habitat for Humanity, Central Arizona / Verdes, can be conveniently dropped off at your HOA office. The homeowners for our current build, #29, were introduced at church services in December. They help with the building and are looking forward to the positive change that comes from being homeowners. January 13, 2025, 4:00 pm Comedian Kenn Kington. Kenn has had 6 comedy specials, appeared on Comedy Central and Netflix, and is currently one of the most-played comics on XM Radio. He has a new Dry Bar special, an award-winning comedy on Amazon Prime, and has appeared on Focus. All are welcome to this free event. No registration is needed.

January 25, 2025, 8:30 am – 3:00 pm Women’s Retreat with Diane Millis “Our Untold Stories” Join us to develop your capacity to author a story that more closely reflects who you are and who God is calling you to become. Registration is required; email assistant@verdefaith.org. The cost is $25, payable at the door. All are welcome.

Individuals in these areas have been found to engage in activities and habits that lead to a higher quality of life as they age . . . All are welcome to this free event.
