4.3 Other Environmental Reviews and Consultation Requirements 4.3.1 Other Environmental Reviews The proposed approximately 8-mile pipeline extension would be reviewed by the FERC. FERC's procedure involves initial scoping to identify environmental concerns, followed by the preparation of its EIS. If all EIS and other criteria are satisfied, FERC may subsequently grant a Certificate of Public Necessity, granting approval for the pipeline project to advance, contingent on TVA's selection of the Action Alternative. 4.3.2 Agency Coordination and Consultations TVA would engage in collaborative efforts with TDEC and the U.S. Army Corp of Engineers (USACE) to address surface water resources. Additionally, coordination would be undertaken with the U.S. Fish and Wildlife Service (USFWS) to address protected and endangered species potentially affected by the Action Alternative. TVA will also work closely with the Tennessee State Historic Preservation Office (SHPO) to address any potentially affected archaeological, architectural, or cultural resources. Consultations regarding the proposed pipeline extension would be conducted by FERC and the selected gas pipeline company. TVA will provide notice to potentially interested state and federal agencies when the Draft EIS is available for review and comment through the Federal Register and via the TVA NEPA website. 5 Public Outreach during Scoping Period On May 12, 2023, TVA published a Notice of Intent (NOI) on its website and subsequently in the Federal Register on May 19, 2023, announcing plans to prepare an EIS to assess the potential environmental effects associated with the proposed construction and operation of the CT plant and BESS. The NOI initiated a 30-day public scoping period. In response to requests received during the public review period, TVA published a second NOI in the Federal Register on June 20 th , extending the public comment period through July 7, 2023. The NOI solicited public input on both the scope of the EIS and environmental issues that should be considered in the EIS. The purpose of the scoping period was to present TVA’s project objectives and initial alternatives for input from the public and interested stakeholders. In addition to the NOI in the Federal Register , TVA invited members of the public as well as Federal, state, and local agencies and federally recognized Indian tribes to comment on the scope of the EIS. Information about this project was listed on TVA’s web page at www.tva.com/nepa. TVA sent notification of the NOI via email to local and state government entities and federal agencies and posted flyers in local businesses. TVA published notices regarding the NOI in the local paper, the Cheatham County Exchange (Appendix B), which is distributed in Ashland City, Kingston Springs, Pegram, and Pleasant View.
