TERMS AND CONDITIONS SUMMARIZED Sellers: Rep. your horse honestly! Get your horse to the sale. Be friendly and willing to answer any and all questions. Buyers: Do your homework, don’t be afraid to ask questions and get outside opinions. Pay promptly and in full. ITS REALLY THAT SIMPLE! (but the below verbiage is also necessary to insure it stays simple) TERMS OF SALE All buyers must register at the auction o ffi ce for a bidder’s number. All horses, carriages, & tack items sold “ as is, where is,” unless seller makes guarantees. All guarantees are between buyer and seller and in no event shall Northern Wyoming Livestock & Equipment LLC be responsible for correctness of warranties or genuineness of description of property. The purchaser must understand they are buying property entirely upon Their own, or their agent’s examination and/or opinion. PLEASE VIEW AND EXAMINE EVERYTHING BEFORE IT IS SOLD. Northern Wyoming Livestock & Equipment LLC reserves the right to reject a bid from any bidder. At the fall of auctioneer’s hammer, ownership of lot passes to highest bidder acknowledged by auctioneer, saying “sold” or otherwise declaring completion of sale. NO SALES must be announced before Animal/Item leaves the ring. Any dispute arising as to any bidding shall be determined by the Auctioneers at their sole discretion, the Auctioneers may immediately put the lot in dispute up again for sale. If any dispute arises after the sale, Northern Wyoming Livestock & Equipment LLC decisions shall be conclusive in all respects. ABSOLUTELY NO PRIVATE SALES BEFORE ANIMAL GOES THROUGH THE RING. ACCEPTED TERMS OF PAYMENT Cash, personal check, cashiers check, or money order accepted forms of payment. CHECKS ACCEPTED ONLY WITH CURRENT, IRREVOCABLE BANK LETTER OR GUARANTEED PAYMENT STATING AMOUNT TO BE COVERED BY CHECK. A 3.75% Fee will be charged on credit or debit card purchases. HITCHING We encourage you to hitch all broke horses, so potential buyers can view horses at work. There is ample Space on grounds to drive in an arena or parking lot. No whips in driving areas. Drive Responsibly! Fore carts will be available for consignors to show their horses. RIDING We encourage the Seller to ride their Horses for potential buyers, the north arena will be set up for riding in and will have trail obstacles available. WARRANTIES There is no implied warranty made by auctioneer or Northern Wyoming Livestock & Equipment LLC as to the merchantability or fi tness for a particular purpose of any animal, item, or equipment in the sale. The seller (consigner and/or trainer) is the responsible party for all representations, warranties, and guarantees expressed or implied concerning the condition of any horse, item, or equipment.Pregnant mares sell as exposed, unless seller provides an ultrasound report dated within 30 days of sale. DELIVERY AND KEEPING Buyers are responsible for care and keeping of the animal after the fall of the hammer. No Animal may leave the property without checking out with the o ffi ce, and being paid in full. All horses, items, and equipment must be paid in full within an hour of the sales
conclusion.Any horses staying on grounds after noon on Sunday, need to check in with stalling o ffi ce and pay additional days. Transport is sole responsibility of Buyer. LIABILITY Everyone is cautioned to exercise care while attending the sale. All persons entering on the premises during the time of the sale do so at their own risk. All parties entering into the grounds upon which the sale is held hereby expressly release the Northern Wyoming Livestock & Equipment LLC and its agents, from any liability or responsibility for injuries sustained by them during the attendance of said sale from any cause or source whatsoever. The horse sale is an equine event and all persons enter at own risk. GUARANTEES Consigners are solely responsible for all guarantees made, Buyers are welcome to a pre- purchase exam at their expense prior to sale, arrangements will need to be made with consigner. Northern Wyoming Livestock & Equipment LLC, its agents, and auctioneers are not responsible for any guarantees made by seller. EXPENSES Cost of selling horses will be 7%, and 4% on all No Saled horses, No Show fee of $500 to any horse that doesn’t enter the ring . All The consignors for tack, equipment & carriage sale will pay a 10% on all sold tack and 4% on no sales over $100, under $100, $5 no sale fee. There is a $20 Health inspection fee, and a $15 brand inspection fee charged to the consignor. IF HORSE IS NO SALED AND SOLD OUTSIDE THE RING, AN 7% FEE IS STILL DUE TO THE SALE MANAGEMENT COMPANY. Buyer pays shipping on all Equipment. STALLS All Sale Horses will have reserved stalls we ask that you put the horses in the stall reserved for it, so Buyers can locate the from the map. Sale horse stalls are available Thursday 8am until Sunday at 12pm. If you need stalls prior to Thursday or after Sunday please contact Sale Management to Reserve stalls ( $10 per stall per day). There are additional stalls available for $10 a day as well. There will be Hay and Shavings available for purchase, at the stall o ffi ce. PAPERWORK ALL HORSES MUST HAVE A NEGATIVE COGGINS TEST WITHIN SIX MONTHS; REGISTRATION PAPERS MUST BE IN ORDER AND A SIGNED TRANSFER A CHECK IN! Pregnant mares are required to have breeding report turned in to o ffi ce prior to sale (if foal is registrable). Horses without Coggins will not be excepted. Powell Veterinary Services will be the Sale veterinarians. IMPORTANT - HALTER Every horse must have a like new leather or nylon halter and lead rope on it before the sale; it goes with the horse. If consignor fails to provide a new leather or nylon halter, the cost of halter will be deducted from the sale price. Attention All Wyoming State Laws and Brand Laws will be enforced P.O.
