Terms, Payments and Conditions

Buyers: By placing a bid in this sale today whether it be live at sale, on phone, or on any online bidding platform you are entering into a legally binding and enforceable contract in which you agree to pay the full amount you bid. If you chose not to accept the purchase and choose not to pay in full and the seller is forced to re - run the animal you will be forced to pay any difference if resale is less that first sale price. Until this matter is resolved you will be suspended immediately from bidding live and / or online. By bidding you also agree to hold harmless the Auctioneer, Herd Builder Pro, Auction Staff of any mis information, defects or and / or issues that may arise from either bidder/ buyer or seller. The Auctioneer as well as auction and management staff will be held harmless of and accidents including but not limited to facilities, animals or and disagreements between buyers and sellers. If an issue arises that cannot be peacefully resolved its advised that parties seek legal counsel. Payment Terms: Payments may be made in cash, good check or major debit or credit card. 4% convenience fee will be added to credit card purchase. (No Exceptions) Checks need to be accompanied by bank letter with a date not to exceed one week prior to sale. Returned checks will have $100 dollar fee applied to balance. (No Exceptions) No animals will be transferred until payment has been made. Animals must be paid for before placed on any haulers trailer as well. Online Bidders And Buyers: Online buyers will be expected to pay by credit card immediately following the sale unless prior arrangements have been made before start of sale. Any arrangements to pay other than debit or credit card need to be made with AUCTIONEER 48 hours prior to sale. Failure to answer and pay at conclusion of sell will void any transportation arrangements that have been made previously unless made with breeder that consigned animal. Buyer is still responsible for payment and is legally bound to pay, however transport will be made from farm animal was purchased from.

Registration Terms: No papers will be transferred until payment has been made. Health certificates will be furnished by seller.All health papers will be issued by Licensed Veterinarian.

BUYER: If papers are transferred to new buyer and payment is not completely made, and/or check was returned for any reason, and/ or charge back was made to credit card, buyer agrees to transfer papers back to seller IMMEDIATELY.

Does: Does are guaranteed to be breeders. In the event a doe is considered a non-breeder after being bred to a buck that is known to be a breeder, the doe MUST have been examined by a Licensed Veterinarian. After all these attempts have been made a letter from Veterinarian and from buyer must be sent to seller within 120 days of sale date. The seller at that time will have an additional 120 days to prove the doe a breeder. In order to prove her a breeder the seller may use any fullblood buck that they have available. There is no guarantee that doe returned bred will deliver kids.Any hormonal or surgical reproduction work after sale will null and void the breeder guarantee. Hormonal techniques and treatment including the use of Cidr’s, PG - 600, Lutalyse and any other hormone or reproductive drugs or procedures will immediately void any breeder guarantee. Bucks: Bucks sold that are 7 months of age or older will be guaranteed to be breeders. If buck fails to be a breeder after multiple attempts on does known to be breeders, and after being examined by Licensed Veterinarian the buyer and Veterinarian that examined buck must send a letter to seller within 120 days of sale date letting the seller know the situation. The seller at that time will have an additional 120 days to prove the buck a breeder. Terms For Settlement: No expenses such as feed, care, interest, or veterinary charges etc. will be charged by either party when settling. If seller is successful in proving the animal in question to be a breeder, then said animal will be reclaimed by the purchaser at his/her expense. Should the seller fail to prove the animal a breeder, then buyer is guaranteed a satisfactory replacement or a full refund of the original purchase price. In any situation an agreement can’t be reached it will be considered a civil matter and its suggested to hire an attorney to take over the situation.

The Auctioneer will be in charge of sale at all times unless otherwise stated in these terms.
